6BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2rebuild Iowa infrastructure fund
3   Section 1.  REBUILD IOWA INFRASTRUCTURE FUND —
4APPROPRIATIONS.
  There is appropriated from the rebuild Iowa
5infrastructure fund to the following departments and agencies
6for the following fiscal years, the following amounts, or so
7much thereof as is necessary, to be used for the purposes
8designated:
   91.  DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
   10a.  (1)  For deposit in the water quality initiative fund
11created in section 466B.45 for purposes of supporting the
12water quality initiative administered by the division of soil
13conservation and water quality as provided in section 466B.42,
14including salaries, support, maintenance, and miscellaneous
15purposes, notwithstanding section 8.57, subsection 5, paragraph
16“c”:
   17FY 2023-2024:

   19(2)  (a)  The moneys appropriated in this lettered
20paragraph shall be used to support demonstration projects in
21subwatersheds as designated by the department that are part
22of high-priority watersheds identified by the water resources
23coordinating council.
   24(b)  The moneys appropriated in this lettered paragraph
25shall be used to support demonstration projects in watersheds
26generally, including regional watersheds, as designated by the
27division and high-priority watersheds identified by the water
28resources coordinating council.
   29(3)  In supporting projects in watersheds and subwatersheds
30as provided in subparagraph (2), all of the following shall
31apply:
   32(a)  The demonstration projects shall utilize water quality
33practices as described in the latest revision of the document
34entitled “Iowa Nutrient Reduction Strategy” initially presented
35in November 2012 by the department of agriculture and land
-1-1stewardship, the department of natural resources, and Iowa
2state university of science and technology.
   3(b)  The division shall implement demonstration projects
4as provided in subparagraph division (a) by providing
5for participation by persons who hold a legal interest in
6agricultural land used in farming. To every extent practical,
7the division shall provide for collaborative participation by
8such persons who hold a legal interest in agricultural land
9located within the same subwatershed.
   10(c)  The division shall implement demonstration projects on
11a cost-share basis as determined by the division. Except for
12edge-of-field practices, the state’s share of the amount shall
13not exceed 50 percent of the estimated cost of establishing the
14practice as determined by the division or 50 percent of the
15actual cost of establishing the practice, whichever is less.
   16(d)  The demonstration projects shall be used to educate
17other persons about the feasibility and value of establishing
18similar water quality practices. The division shall promote
19field day events for purposes of allowing interested persons to
20establish water quality practices on their agricultural land.
   21(e)  The division shall conduct water quality evaluations
22within supported subwatersheds. Within a reasonable period
23after accumulating information from such evaluations, the
24division shall create an aggregated database of water quality
25practices. Any information identifying a person holding a
26legal interest in agricultural land or specific agricultural
27land shall be a confidential record.
   28(4)  The moneys appropriated in this lettered paragraph
29shall be used to support education and outreach in a manner
30that encourages persons who hold a legal interest in
31agricultural land used for farming to implement water quality
32practices, including the establishment of such practices in
33watersheds generally, and not limited to subwatersheds or
34high-priority watersheds.
   35(5)  The moneys appropriated in this lettered paragraph
-2-1may be used to contract with persons to coordinate the
2implementation of efforts provided in this paragraph.
   3(6)  The moneys appropriated in this lettered paragraph
4may be used by the department to support urban soil and water
5conservation efforts, which may include but are not limited
6to management practices related to bioretention, landscaping,
7the use of permeable or pervious pavement, and soil quality
8restoration. The moneys shall be allocated on a cost-share
9basis as provided in chapter 161A.
   10(7)  Notwithstanding any other provision of law to the
11contrary, the department may use moneys appropriated in
12this lettered paragraph to carry out the provisions of this
13paragraph on a cost-share basis in combination with other
14moneys available to the department from a state or federal
15source.
   16(8)  Not more than 10 percent of the moneys appropriated in
17this lettered paragraph may be used for costs of administration
18and implementation of the water quality initiative administered
19by the soil conservation division.
   20b.  For deposit in the renewable fuels infrastructure fund
21created in section 159A.16 for renewable fuel infrastructure
22programs:

4CHANGES TO PRIOR APPROPRIATIONS
5   Sec. 5.  2021 Iowa Acts, chapter 167, section 2, is amended
6to read as follows:
   7SEC. 2.  REVERSION.  For Except as provided in subsection
82, for
purposes of section 8.33, unless specifically provided
9otherwise, unencumbered or unobligated moneys from an
10appropriation made in this division of this Act shall not
11revert but shall remain available for expenditure for the
12purposes designated until the close of the fiscal year that
13ends two years after the end of the fiscal year for which the
14appropriation is made. However, if the project or projects for
15which such appropriation was made are completed in an earlier
16fiscal year, unencumbered or unobligated moneys shall revert at
17the close of that same fiscal year.
   182.  For purposes of section 8.33, unless specifically
19provided otherwise, unencumbered or unobligated moneys from
20an appropriation made in section 1, subsection 10, paragraph
21“d”, of this division of this 2021 Iowa Act, as amended by 2022
22Iowa Acts, chapter 1150, section 11, shall not revert but shall
23remain available for expenditure for the purposes designated
24until the project for which the appropriation was made is
25completed.
26   Sec. 6.  Section 8.57C, subsection 3, paragraph a,
27subparagraph (3), Code 2023, is amended to read as follows:
   28(3)  For the fiscal year beginning July 1, 2023 2024, and for
29each subsequent fiscal year thereafter, the sum of seventeen
30million five hundred thousand dollars.
31DIVISION IV
32MISCELLANEOUS PROVISIONS
33   Sec. 7.  Section 8.57C, subsection 3, Code 2023, is amended
34by adding the following new paragraph:
35   NEW PARAGRAPH.  k.  There is appropriated from the rebuild
-12-1Iowa infrastructure fund for the fiscal year beginning July
21, 2023, and ending June 30, 2024, the sum of seventeen
3million four hundred seventy-six thousand fifty dollars to the
4technology reinvestment fund, notwithstanding section 8.57,
5subsection 5, paragraph “c”.
6EXPLANATION
7The inclusion of this explanation does not constitute agreement with
8the explanation’s substance by the members of the general assembly.
   9This bill relates to and makes appropriations to state
10departments and agencies from the rebuild Iowa infrastructure
11fund and the technology reinvestment fund, and provides for
12related matters. The bill is organized by divisions.
   13DIVISION I — REBUILD IOWA INFRASTRUCTURE FUND. This
14division appropriates project funding for FY 2023-2024 from
15the rebuild Iowa infrastructure fund for projects for the
16departments of agriculture and land stewardship, the blind,
17corrections, health and human services, natural resources,
18public defense, public safety, and transportation, and for the
19economic development authority, treasurer of state, ethics and
20campaign disclosure board, and Iowa communications network.
21The division also appropriates project funding from the rebuild
22Iowa infrastructure fund for multiple fiscal years to the
23department of education and the board of regents.
   24DIVISION II — TECHNOLOGY REINVESTMENT FUND. This division
25appropriates project funding for FY 2023-2024 from the
26technology reinvestment fund for projects for the departments
27of justice, corrections, education, health and human services,
28homeland security and emergency management, management, and
29revenue, and for the auditor of state, and the board of parole.
   30DIVISION III — CHANGES TO PRIOR APPROPRIATIONS. This
31division allows moneys appropriated from the rebuild Iowa
32infrastructure fund to the department of public defense for a
33readiness center in FY 2021-2022 and FY 2022-2023 to not revert
34but to remain available for expenditure until the project is
35completed.

   1DIVISION IV — MISCELLANEOUS PROVISIONS. Code section
28.57C, concerning the technology reinvestment fund, is amended
3to provide that the standing appropriation to the fund from the
4general fund for fiscal years beginning on or after July 1,
52023, is changed to fiscal years beginning on or after July 1,
62024, and to provide for an appropriation to the fund from the
7rebuild Iowa infrastructure fund for the fiscal year beginning
8July 1, 2023, of $17.46 million.
