2individuals who meet the nursing home level of care and are
3required to register as sex offenders.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  MEDICAID REIMBURSEMENT — NURSING FACILITY
2LEVEL OF CARE — SECURE UNIT — INDIVIDUALS ON SEX OFFENDER
3REGISTRY.
  No later than January 1, 2024, the department of
4health and human services shall implement a reimbursement rate
5add-on methodology under the Medicaid program for services
6provided by a skilled nursing facility or nursing facility that
7designates a secure unit, that is separate and secure from
8residents with chronic confusion or a dementing illness and all
9other skilled nursing facility and nursing facility residents,
10to provide services to individuals that are required to
11register as sex offenders pursuant to chapter 692 and who meet
12nursing facility level of care requirements. The department of
13health and human services shall inflate the reimbursement rate
14add-on, annually, from the midpoint of the prior state fiscal
15year to the midpoint of the current state fiscal year using the
16currently available CMS/SNF index.
17EXPLANATION
18The inclusion of this explanation does not constitute agreement with
19the explanation’s substance by the members of the general assembly.
   20This bill requires that no later than January 1, 2024, the
21department of health and human services shall implement a
22Medicaid reimbursement rate add-on methodology, including an
23annual inflation adjustment, for services provided by a skilled
24nursing facility or nursing facility that designates a secure
25unit to provide services to individuals who are required to
26register as sex offenders and meet nursing facility level of
27care requirements.
