4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2MEDICAID EXTENDED POSTPARTUM COVERAGE
3   Section 1.  MEDICAID EXTENDED POSTPARTUM COVERAGE
4OPTION.
  The department of health and human services shall
5submit a Medicaid state plan amendment to the centers for
6Medicare and Medicaid services of the United States department
7of health and human services for approval of the option
8to provide twelve months of continuous postpartum coverage
9under the Medicaid program to pregnant women enrolled in the
10Medicaid program in accordance with sections 9812 and 9822
11of the federal American Rescue Plan Act of 2021, Pub.L.No.
12117-2, as amended by section 5113 of the federal Consolidated
13Appropriations Act of 2023.
14   Sec. 2.  EFFECTIVE DATE.  This division of this Act, being
15deemed of immediate importance, takes effect upon enactment.
16DIVISION II
17POSTPARTUM COVERAGE APPROPRIATION
18   Sec. 3.  MEDICAID EXTENDED POSTPARTUM COVERAGE —
19APPROPRIATION.
  There is appropriated from the general fund of
20the state to the department of human services for the following
21fiscal years, the following amounts or so much thereof as is
22necessary to fund extended postpartum coverage to pregnant
23women enrolled in the Medicaid program in accordance with this
24Act:
   25FY 2023-2024:

29EXPLANATION
30The inclusion of this explanation does not constitute agreement with
31the explanation’s substance by the members of the general assembly.
   32DIVISION I — MEDICAID EXTENDED POSTPARTUM COVERAGE. Under
33current federal law, pregnant Medicaid beneficiaries are
34eligible for at least pregnancy-related services through the
35end of the month in which the 60-day period beginning on the
-1-1last day of the pregnancy ends.
   2Provisions of the federal American Rescue Plan Act of 2021
3(H.R.1319) provide the option to states to submit a state
4plan amendment to provide postpartum Medicaid coverage for 12
5months after the end of a pregnancy for a five-year period. A
6provision under the federal Consolidated Appropriations Act of
72023 removed the five-year limitation.
   8This division requires the department of health and human
9services (HHS) to submit a Medicaid state plan amendment to the
10centers for Medicare and Medicaid services of the United States
11department of health and human services for approval of the new
12option to provide 12 months of continuous postpartum coverage
13under the Medicaid program to pregnant women enrolled in the
14Medicaid program.
   15The division of the bill takes effect upon enactment.
   16DIVISION II — MEDICAID EXTENDED POSTPARTUM COVERAGE —
17APPROPRIATION. This division of the bill appropriates moneys
18from the general fund of the state to HHS for FY 2023-2024 and
19FY 2024-2025 for the state costs of postpartum coverage under
20the Medicaid program.
