2DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
3GENERAL FUND APPROPRIATIONS
4   Section 1.  GENERAL FUND — DEPARTMENT.
   51.  There is appropriated from the general fund of the state
6to the department of agriculture and land stewardship for the
7fiscal year beginning July 1, 2023, and ending June 30, 2024,
8the following amount, or so much thereof as is necessary, to be
9used for the purposes designated:
   10For purposes of supporting the department, including its
11divisions, for administration, regulation, and programs; for
12salaries, support, maintenance, and miscellaneous purposes; and
13for not more than the following full-time equivalent positions:

   162.  Of the amount appropriated in subsection 1, the following

23of management. The report shall describe in detail the

26DESIGNATED Appropriations From MISCELLANEOUS FUNDS
27   Sec. 2.  UNCLAIMED PARI-MUTUEL WAGERING WINNINGS —
28HORSE AND DOG RACING.
  There is appropriated from the moneys
29available under section 99D.13 to the department of agriculture
30and land stewardship for the fiscal year beginning July 1,
312023, and ending June 30, 2024, the following amount, or so
32much thereof as is necessary, to be used for the purposes
33designated:
   34For purposes of supporting the department’s administration
35and enforcement of horse and dog racing law pursuant to section
-1-199D.22, including for salaries, support, maintenance, and
2miscellaneous purposes:

4   Sec. 3.  RENEWABLE FUEL INFRASTRUCTURE FUND — MOTOR
5FUEL INSPECTION.
  There is appropriated from the renewable
6fuel infrastructure fund created in section 159A.16 to the
7department of agriculture and land stewardship for the fiscal
8year beginning July 1, 2023, and ending June 30, 2024, the
9following amount, or so much thereof as is necessary, to be
10used for the purposes designated:

12salaries, support, maintenance, and miscellaneous purposes:

15   Sec. 4.  SPECIAL APPROPRIATIONS FROM GENERAL FUND TO
16DEPARTMENT.
  There is appropriated from the general fund of the
17state to the department of agriculture and land stewardship
18for the fiscal year beginning July 1, 2023, and ending June
1930, 2024, the following amounts, or so much thereof as is
20necessary, to be used for the purposes designated:
   211.  DAIRY REGULATION
   22a.  For purposes of performing functions pursuant to section
23192.109, including conducting a survey of grade “A” milk and
24certifying the results to the secretary of agriculture:

   26b.  Notwithstanding section 8.33, moneys appropriated in
27this subsection that remain unencumbered or unobligated at the
28close of the fiscal year shall not revert but shall remain

   312.  LOCAL FOOD AND FARM PROGRAM
   32a.  For purposes of supporting the local food and farm
33program pursuant to chapter 267A:

2the local food and farm program coordinator position as part of
3the university’s cooperative extension service in agriculture
4and home economics pursuant to chapter 267A.

6this subsection that remain unencumbered or unobligated at the
7close of the fiscal year shall not revert but shall remain
8available for expenditure for the purposes designated until the
9close of the succeeding fiscal year.
   103.  AGRICULTURAL EDUCATION
   11a.  For purposes of allocating moneys to an Iowa association
12affiliated with a national organization that promotes
13agricultural education providing for future farmers:

   15b.  Notwithstanding section 8.33, moneys appropriated in
16this subsection that remain unencumbered or unobligated at the
17close of the fiscal year shall not revert but shall remain
18available for expenditure for the purposes designated until the

   204.  FOREIGN ANIMAL DISEASES AFFLICTING LIVESTOCK
   21For deposit in the foreign animal disease preparedness and
22response fund created in section 163.3B:

   245.  FARMERS WITH DISABILITIES PROGRAM
   25a.  For purposes of supporting a program for farmers with
26disabilities:

   28b.  The moneys appropriated in this subsection shall be
29used for the public purpose of providing a grant to a national
30nonprofit organization with over 80 years of experience in
31assisting children and adults with disabilities and special
32needs. The moneys shall be used to support a nationally
33recognized program that began in 1986 and has been replicated
34in at least 30 other states, but is not available through
35any other entity in this state, and that provides assistance
-3-1to farmers with disabilities in all 99 counties to allow the
2farmers to remain in their own homes and be gainfully engaged
3in farming through provision of agricultural worksite and home
4modification consultations, peer support services, services
5to families, information and referral, and equipment loan
6services.
   7c.  Notwithstanding section 8.33, moneys appropriated in
8this subsection that remain unencumbered or unobligated at the
9close of the fiscal year shall not revert but shall remain
10available for expenditure for the purposes designated until the
11close of the succeeding fiscal year.
   126.  LOESS HILLS DEVELOPMENT AND CONSERVATION FUND
   13a.  For deposit in the loess hills development and
14conservation fund created pursuant to section 161D.2:

   16b.  (1)  Of the amount appropriated to the loess hills
17development and conservation fund in this subsection, $_______
18shall be allocated to the fund’s hungry canyons account.

   29a.  For deposit in the southern Iowa development and
30conservation fund created pursuant to section 161D.12:

24   Sec. 5.  GENERAL FUND — DEPARTMENT.
   251.  There is appropriated from the general fund of the state
26to the department of natural resources for the fiscal year
27beginning July 1, 2023, and ending June 30, 2024, the following
28amount, or so much thereof as is necessary, to be used for the
29purposes designated:
   30For purposes of supporting the department, including its
31divisions, for administration, regulation, and programs; for
32salaries, support, maintenance, and miscellaneous purposes; and
33for not more than the following full-time equivalent positions:

   12.  Of the number of full-time equivalent positions
2authorized to the department pursuant to subsection 1, _____
3full-time equivalent positions shall be allocated by the
4department for seasonal employees for purposes of providing
5maintenance, upkeep, and sanitary services at state parks.
6This subsection shall not impact conservation officer, park
7ranger, or park manager positions within the department.
   83.  The department shall submit a report each quarter of
9the fiscal year to the general assembly and the department
10of management. The report shall describe in detail the
11expenditure of moneys appropriated under this section to
12support the department’s administration, regulation, and
13programs.
14   Sec. 6.  STATE FISH AND GAME PROTECTION FUND — REGULATION
15AND ADVANCEMENT OF OUTDOOR ACTIVITIES.
   161.  There is appropriated from the state fish and game
17protection fund created pursuant to section 456A.17 to the
18department of natural resources for the fiscal year beginning
19July 1, 2023, and ending June 30, 2024, the following amount,
20or so much thereof as is necessary, to be used for the purposes
21designated:
   22For purposes of supporting the regulation or advancement of
23hunting, fishing, or trapping, or the protection, propagation,
24restoration, management, or harvest of fish or wildlife,
25including for administration, regulation, law enforcement, and
26programs; and for salaries, support, maintenance, equipment,
27and miscellaneous purposes:

   292.  Notwithstanding section 455A.10, the department may use
30the unappropriated balance remaining in the state fish and game
31protection fund to provide for the funding of health and life
32insurance premium payments from unused sick leave balances of
33conservation peace officers employed in a protection occupation
34who retire, pursuant to section 97B.49B.
   353.  Notwithstanding section 455A.10, the department may
-6-1use the unappropriated balance remaining in the state fish
2and game protection fund for the fiscal year beginning July
31, 2023, and ending June 30, 2024, as is necessary to fund
4salary adjustments for departmental employees for which the
5general assembly has made an operating budget appropriation in
6subsection 1.
7   Sec. 7.  GROUNDWATER PROTECTION FUND — WATER QUALITY.  There
8is appropriated from the groundwater protection fund created
9in section 455E.11 to the department of natural resources for
10the fiscal year beginning July 1, 2023, and ending June 30,
112024, from those moneys that are not allocated pursuant to
12that section, the following amount, or so much thereof as is
13necessary, to be used for the purposes designated:
   14For purposes of supporting the department’s protection
15of the state’s groundwater, including for administration,
16regulation, and programs, and for salaries, support,
17maintenance, equipment, and miscellaneous purposes:

9to Iowa state university of science and technology for the
10fiscal year beginning July 1, 2023, and ending June 30, 2024,
11the following amount, or so much thereof as is necessary, to be
12used for the purposes designated:
   13For purposes of supporting the college of veterinary
14medicine for the operation of the veterinary diagnostic
15laboratory and for not more than the following full-time
16equivalent positions:

   192.  a.  Iowa state university of science and technology
20shall not reduce the amount that it allocates to support the
21college of veterinary medicine from any other source due to the
22appropriation made in this section.
   23b.  Paragraph “a” does not apply to a reduction made to

25percentage of reduction imposed on the college of veterinary
26medicine is also imposed on all of Iowa state university of
27science and technology’s budget units.
   283.  If by June 30, 2024, Iowa state university of science and
29technology fails to allocate the moneys appropriated in this
30section to the college of veterinary medicine in accordance
31with this section, the moneys appropriated in this section for
32that fiscal year shall revert to the general fund of the state.
33   Sec. 12.  LIVESTOCK DISEASE RESEARCH.
   341.  There is appropriated from the general fund of the state
35to Iowa state university of science and technology for the
-9-1fiscal year beginning July 1, 2023, and ending June 30, 2024,
2the following amount, or so much thereof as is necessary, to be
3used for the purposes designated:
   4For deposit in the livestock disease research fund created
5in section 267.8:

   72.  Moneys appropriated under subsection 1 shall be used
8by Iowa state university of science and technology to support
9animal disease research in areas of importance to livestock

11DIVISION IV
12STATE UNIVERSITY OF IOWA
13SPECIAL GENERAL FUND Appropriations
14   Sec. 13.  IOWA’S CENTER FOR AGRICULTURAL SAFETY AND HEALTH
15(I-CASH).
   161.  There is appropriated from the general fund of the state
17to the state university of Iowa for the fiscal year beginning
18July 1, 2023, and ending June 30, 2024, the following amount,
19or so much thereof as is necessary, to be used for the purposes
20designated:
   21For supporting the operations of Iowa’s center for
22agricultural safety and health, as part of the university’s
23college of public health, and in cooperation with the
24department of agriculture and land stewardship, to anticipate,
25recognize, and prevent occupational illness and injury among
26members of the agricultural community:

   282.  a.  As a condition of the appropriation made in
29subsection 1, the state university of Iowa shall retain the
30director of Iowa’s center for agricultural safety and health
31employed on the effective date of this division of this Act for
32at least the same number of hours for the fiscal year beginning
33July 1, 2023, as worked by the director during the fiscal year
34beginning July 1, 2022.
   35b.  As a condition of the appropriation made in subsection
-10-11, the state university of Iowa shall not reduce the amount
2allocated to support Iowa’s center for agricultural safety and
3health from any other source due to the appropriation made in
4subsection 1.
   53.  If by June 30, 2024, the state university of Iowa fails
6to use the moneys appropriated in subsection 1 in accordance
7with the purposes and conditions of subsections 1 and 2, any
8unencumbered or unobligated moneys appropriated in subsection
91 for the fiscal year beginning July 1, 2023, and ending June
1030, 2024, shall revert to the general fund of the state. In
11addition, if moneys revert as required pursuant to section
128.33, the state university of Iowa shall transfer to the
13general fund of the state from any otherwise unencumbered or
14unobligated moneys from any other general fund appropriation or
15from any moneys available from other funding sources an amount
16equal to the amount appropriated in subsection 1 less any
17amount that reverted to the general fund of the state pursuant
18to section 8.33.
19DIVISION V
20environment first fund
21general appropriations
22   Sec. 14.  DEPARTMENT OF AGRICULTURE AND LAND
23STEWARDSHIP.
  There is appropriated from the environment first
24fund created in section 8.57A to the department of agriculture
25and land stewardship for the fiscal year beginning July 1,
262023, and ending June 30, 2024, the following amounts, or so
27much thereof as is necessary, to be used for the purposes
28designated:
   291.  CONSERVATION RESERVE ENHANCEMENT PROGRAM (CREP)
   30a.  For the conservation reserve enhancement program to
31restore and construct wetlands for the purposes of intercepting
32tile line runoff, reducing nutrient loss, improving water
33quality, and enhancing agricultural production practices:

   35b.  Not more than 10 percent of the moneys appropriated
-11-1in paragraph “a” may be used for costs of administration and
2implementation of soil and water conservation practices.
   3c.  Notwithstanding any other provision of law, the
4department may use moneys appropriated in this subsection,
5in combination with other appropriate environment first
6fund appropriations, for cost sharing to match United States
7department of agriculture, natural resources conservation
8service, wetlands reserve enhancement program (WREP) funding
9available to Iowa.
   102.  WATERSHED PROTECTION
   11a.  For continuation of a program that provides
12multiobjective resource protections for flood control, water
13quality, erosion control, and natural resource conservation:

   15b.  Not more than 10 percent of the moneys appropriated
16in paragraph “a” may be used for costs of administration and
17implementation of soil and water conservation practices.
   183.  CONSERVATION RESERVE PROGRAM (CRP)
   19a.  To encourage and assist farmers in enrolling in and the
20implementation of the federal conservation reserve program and
21to work with them to enhance their revegetation efforts to
22improve water quality and habitat:

   24b.  Not more than 10 percent of the moneys appropriated
25in paragraph “a” may be used for costs of administration and
26implementation of soil and water conservation practices.
   274.  SOIL AND WATER CONSERVATION
   28a.  For use by the department in providing for soil and water
29conservation:

   31b.  (1)  Of the amount appropriated in paragraph “a”, for
32transfer to the hungry canyons account of the loess hills
33development and conservation fund created in section 161D.2:

   35(2)  Not more than 10 percent of the moneys transferred to

2(1) may be used for administrative costs.
   3c.  Of the remaining amount appropriated in paragraph “a”,
4for use by the department in providing for soil and water
5conservation administration, the conservation of soil and
6water resources, or the support of soil and water conservation
7districts:

   9d.  Of the amount appropriated in paragraph “c” that the
10department allocates to a soil and water conservation district,
11the first $______ may be expended by the district for the
12purpose of providing financial incentives under section 161A.73
13to establish management practices for the control of soil
14erosion on land that is row-cropped, including but not limited
15to nontill planting, ridge-till planting, and contouring
16strip-cropping. Of any remaining amount of that appropriation
17allocated by the department to a district, 30 percent may be
18expended by the district for that same purpose.
   19e.  Not more than 5 percent of the moneys appropriated in
20paragraph “c” may be allocated for cost sharing to address
21complaints filed under section 161A.47.
   22f.  Of the moneys appropriated in paragraph “c”, 5 percent
23shall be allocated for financial incentives to establish
24practices to protect watersheds above publicly owned lakes of
25the state from soil erosion and sediment as provided in section
26161A.73.
   27g.  The state soil conservation and water quality committee
28established by section 161A.4 may allocate moneys appropriated
29in paragraph “c” to conduct research and demonstration projects
30to promote conservation tillage and nonpoint source pollution
31control practices.
   32h.  The allocation of moneys as financial incentives as
33provided in section 161A.73 may be used in combination with
34moneys allocated by the department of natural resources.
   35i.  Not more than 15 percent of the moneys appropriated
-13-1in paragraph “c” may be used for costs of administration and
2implementation of soil and water conservation practices.
   35.  SOIL AND WATER CONSERVATION — ADMINISTRATION
   4a.  For use by the department for costs of administration and
5implementation of soil and water conservation practices:

  341.  a.  Except as provided in paragraph “b”, and

3the fiscal year shall not revert but shall remain available
4for expenditure for the purposes designated until the close of
5the succeeding fiscal year, or until the project for which the
6appropriation was made is completed, whichever is earlier.
   7b.  Notwithstanding section 8.33, moneys appropriated for
8the fiscal year beginning July 1, 2023, in this division of
9this Act to the department of agriculture and land stewardship
10to provide financial assistance for the establishment of
11permanent soil and water conservation practices that remain
12unencumbered or unobligated at the close of the fiscal year
13shall not revert but shall remain available for expenditure
14for the purposes designated until the close of the fiscal year
15beginning July 1, 2026.
   162.  Subsection 1 does not apply to moneys transferred
17pursuant to this division of this Act to the loess hills
18development and conservation fund created in section 161D.2,
19which shall not revert as provided in that section.
20DIVISION VI
21ENVIRONMENT FIRST FUND
22SPECIAL APPROPRIATIONS
23   Sec. 18.  WATER QUALITY INITIATIVE — DEPARTMENT OF
24AGRICULTURE AND LAND STEWARDSHIP.
   251.  There is appropriated from the environment first fund
26created in section 8.57A to the department of agriculture
27and land stewardship for the fiscal year beginning July 1,
282023, and ending June 30, 2024, the following amount, or so
29much thereof as is necessary, to be used for the purposes
30designated:
   31For deposit in the water quality initiative fund created in
32section 466B.45, for purposes of supporting the water quality
33initiative administered by the division of soil conservation
34and water quality as provided in section 466B.42, including
35salaries, support, maintenance, and miscellaneous purposes:

   22.  a.  The moneys appropriated in subsection 1 shall be
3used to support projects in subwatersheds as designated by the
4division that are part of high-priority watersheds identified
5by the water resources coordinating council established
6pursuant to section 466B.3.
   7b.  The moneys appropriated in subsection 1 shall be used to
8support projects in watersheds generally, including regional
9watersheds, as designated by the division and high-priority
10watersheds identified by the water resources coordinating
11council established pursuant to section 466B.3.
   123.  In supporting projects in subwatersheds and watersheds
13as provided in subsection 2, all of the following apply:
   14a.  The demonstration projects shall utilize water quality
15practices as described in the Iowa nutrient reduction strategy
16as defined in section 455B.171.
   17b.  The division shall implement demonstration projects as
18provided in paragraph “a” by providing for participation by
19persons who hold a legal interest in agricultural land used in
20farming. To every extent practical, the division shall provide
21for collaborative participation by such persons who hold a
22legal interest in agricultural land located within the same
23subwatershed.
   24c.  The division shall implement a demonstration project on
25a cost-share basis as determined by the division. However,
26except for edge-of-field practices, the state’s share of the
27amount shall not exceed 50 percent of the estimated cost of
28establishing the practice as determined by the division or
2950 percent of the actual cost of establishing the practice,
30whichever is less.
   31d.  The demonstration projects shall be used to educate other
32persons about the feasibility and value of establishing similar
33water quality practices. The division shall promote field day
34events for purposes of allowing interested persons to establish
35water quality practices on their agricultural land.

   1e.  The division shall conduct water quality evaluations
2within supported subwatersheds. Within a reasonable period
3after accumulating information from such evaluations, the
4division shall create an aggregated database of water quality
5practices. Any information identifying a person holding a
6legal interest in agricultural land or specific agricultural
7land shall be a confidential record under section 22.7.
   84.  The moneys appropriated in subsection 1 shall be used
9to support education and outreach in a manner that encourages
10persons who hold a legal interest in agricultural land used for
11farming to implement water quality practices, including the
12establishment of such practices in watersheds generally, and
13not limited to subwatersheds or high-priority watersheds.
   145.  The moneys appropriated in subsection 1 may be used
15to contract with persons to coordinate the implementation of
16efforts provided in this section.
   176.  The moneys appropriated in subsection 1 may be used by
18the department to support urban soil and water conservation
19efforts, which may include but are not limited to management
20practices related to bioretention, landscaping, the use of
21permeable or pervious pavement, and soil quality restoration.
22The moneys shall be allocated on a cost-share basis as provided
23in chapter 161A.
   247.  Notwithstanding any other provision of law to the
25contrary, the department may use moneys appropriated in
26subsection 1 to carry out the provisions of this section on a
27cost-share basis in combination with other moneys available to
28the department from a state or federal source.
   298.  Not more than 10 percent of the moneys appropriated in
30this section may be used to pay for the costs of administering
31and implementing the water quality initiative by the
32department’s division of soil conservation and water quality as
33provided in section 466B.42 and this section.

35IOWA RESOURCES ENHANCEMENT AND PROTECTION FUND

10MAINTENANCE AND REPAIR.
  Notwithstanding section 455A.19,
11subsection 1, paragraph “a”, subparagraph (1), of the moneys
12allocated to the open spaces account of the Iowa resources
13enhancement and protection fund, up to $_________ may be
14used by the department of natural resources for state park
15maintenance and repair for the fiscal year beginning July 1,
162023, and ending on June 30, 2024.
17EXPLANATION
18The inclusion of this explanation does not constitute agreement with
19the explanation’s substance by the members of the general assembly.
   20GENERAL. This bill relates to agriculture and natural
21resources by making appropriations for FY 2023-2024 to support
22related entities, including the department of agriculture and
23land stewardship (DALS), the department of natural resources
24(DNR), Iowa state university (ISU), and the university of Iowa
25(UI).
   26The bill primarily appropriates moneys to DALS and DNR.
27 The appropriations are made to support those departments for
28administration, regulation, and support of programs. The bill
29requires the departments to submit quarterly reports to the
30general assembly and department of management regarding the
31expenditure of appropriated moneys. The bill also provides
32moneys to support specific programs or projects administered by
33those departments.
   34The bill primarily appropriates moneys from the state
35general fund (GF) and the environment first fund (EFF) to
-19-1support DALS and DNR, but also UI and ISU, and to support
2a number of designated activities, projects, and programs
3administered by those agencies. General appropriations are
4made from other major sources, including the state fish and
5game protection fund (SFGPF) and the groundwater protection
6fund (GPF), both administered by DNR. Finally, appropriations
7are made from and to a number of dedicated sources, including
8the resources enhancement and protection (REAP) fund
9administered by DNR, and the renewable fuel infrastructure
10fund (RFIF) and the water quality initiative fund (WQIF)
11administered by DALS.
   12DALS — GF APPROPRIATIONS. The bill appropriates moneys
13to DALS from the GF in order to support its administrative
14divisions, including consumer protection and industry services,
15soil conservation, and food safety and animal health. Moneys
16are transferred to ISU to support its midwest grape and wine
17industry institute.
   18DALS — DESIGNATED APPROPRIATIONS FROM MISCELLANEOUS FUNDS.
19 The bill appropriates moneys from several sources to support a
20number of designated purposes, including moneys derived from
21unclaimed winnings from horse and dog races, for administration
22and enforcement of racing regulations; and moneys credited to
23the RFIF, for purposes of regulating motor fuel.
   24DALS — SPECIAL GF APPROPRIATIONS. The bill makes special
25appropriations from the GF to DALS in order to support specific
26purposes including milk inspection, the local food and farm
27program, an agricultural education organization, foreign animal
28disease preparedness, assistance to farmers with disabilities,
29loess hills protections, southern Iowa development and
30conservation, grain regulation, a value added agriculture grant
31program, and the choose Iowa promotional program.
   32DNR — GF AND OTHER MAJOR FUNDS APPROPRIATIONS. The bill
33makes appropriations from a number of funds to DNR in order
34to support its administrative divisions involving natural
35resources and environmental protection from the GF, the SFGPF,

   2DNR — DESIGNATED APPROPRIATIONS FROM MISCELLANEOUS FUNDS.
3 The bill appropriates moneys to DNR from a number of sources
4to support designated purposes, including moneys deposited in
5the special snowmobile fund to provide for administering and
6enforcing the state snowmobile programs; and moneys deposited
7in the unassigned revenue fund for purposes of paying for
8administration of DNR’s underground storage tanks section.
   9DNR — SPECIAL GF APPROPRIATIONS. The bill makes special
10appropriations from the GF to DNR in order to support specific
11purposes including floodplain management, dam safety and
12forestry health management programs, and state parks.
   13ISU — SPECIAL GF APPROPRIATIONS. The bill appropriates
14moneys from the GF to ISU to support the operation of its
15veterinary diagnostic laboratory and livestock disease
16research.
   17UI — SPECIAL GF APPROPRIATIONS. The bill appropriates
18moneys from the GF to UI to support the operations of Iowa’s
19center for agricultural safety and health, which is part of
20UI’s college of public health.
   21DALS, DNR, AND UI — EFF — GENERAL APPROPRIATIONS. The
22bill appropriates moneys from the EFF to support a number of
23programs administered by DALS, DNR, and UI. For DALS, the
24moneys are appropriated to support programs involving soil
25conservation, watershed protection and nutrient management,
26and the loess hills development and conservation fund. For
27DNR, moneys are appropriated to support programs involving
28state parks, geographic information systems, water quality
29monitoring, public water supplies, regulation of animal feeding
30operations, air quality, and floodplain management and dam
31safety. For UI, moneys are appropriated to support the Iowa
32geological survey. The bill includes provisions that delay the
33reversion of these moneys.
   34EFF — SPECIAL APPROPRIATIONS FOR WQIF. The bill
35appropriates moneys from the EFF to the WQIF subject to certain

   2REAP FUND — EFF APPROPRIATION IN LIEU OF GF APPROPRIATION.
3 The bill appropriates moneys from the EFF to the REAP
4fund instead of the $20 million otherwise required to be
5appropriated to the REAP fund from the GF. Notwithstanding
6the standing allocation from the REAP fund to its open spaces
7account, DNR may use moneys in the account for state park
8maintenance and repair.
