4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 267.1, Code 2023, is amended by striking
2the section and inserting in lieu thereof the following:
   3267.1  Definitions.
   4As used in this chapter, unless the context otherwise
5requires:
   61.  “College of veterinary medicine” means the Iowa state
7university of science and technology college of veterinary
8medicine.
   92.  “Council” means the livestock health advisory council
10created pursuant to section 267.2.
   113.  “Fund” means the livestock disease research fund created
12in section 267.8.
   134.  “Livestock” means the same as defined in section 717.1.
   145.  “Member organization” means an organization appointing
15one or more members to the council pursuant to sections 267.2
16and 267.3.
   176.  “Producer” means a person engaged in the business of
18producing livestock for profit.
19   Sec. 2.  Section 267.2, Code 2023, is amended to read as
20follows:
   21267.2  Livestock health advisory council creation and
22membership
.
   231.  There is a A livestock health advisory council, referred
24to in this chapter as the council
 is created to support
25research of livestock diseases conducted by the college of
26veterinary medicine
.
   272.  The council shall consist of all of the following:
   281.    a.  Three cattle producers appointed by the Iowa
29cattlemen’s association, one of whom shall serve an initial
30term of one year, and one of whom shall serve an initial term
31of two years.
   322.    b.  Three swine producers appointed by the Iowa pork
33producers association, one of whom shall serve an initial term
34of one year.
   353.    c.  One sheep producer appointed by the Iowa sheep
-1-1producers association who shall serve an initial term of one
2year.
   34.    d.  One poultry producer appointed by the Iowa north
4central
poultry association who shall serve an initial term of
5two years.
   6e.  One turkey producer appointed by the Iowa turkey
7federation who shall serve an initial term of three years.
   85.    f.  One milk producer appointed by the Iowa state dairy
9association who shall serve an initial term of two years; and.
   106.    g.  One practicing veterinarian appointed by the Iowa
11veterinary medical association.
12   Sec. 3.  Section 267.3, Code 2023, is amended to read as
13follows:
   14267.3  Terms and vacancies — expenses and compensation
15prohibited
.
   161.  Except as provided in section 267.2, each member of
17the council
shall be appointed by a member organization for a
18three-year term beginning on July 1 of the year of appointment.
19No A member shall not serve more than two terms, including any
20portion of a term served pursuant to the filling of a vacancy.
21Vacancies A vacancy shall be filled by the appropriate member
22 organization in the same manner as appointing a full-term
23members member.
   242.  A member of the council is not entitled to receive
25expenses incurred in the discharge of the member’s duties
26on the council. A member is also not entitled to receive
27compensation as otherwise provided in section 7E.6.
28   Sec. 4.  Section 267.5, Code 2023, is amended to read as
29follows:
   30267.5  Duties and objectives of council.
   31The livestock health advisory council shall do all of the
32following
:
   331.  Elect a chairperson and such other officers as it deems
34advisable. Officers of the council shall serve for terms of
35one year. No A member may shall not serve in any one office for

   22.  Hold a meeting twice each year at Iowa state university
3of science and technology. The council shall meet
with the
4Iowa state university faculty of the college of veterinary
5medicine. Hold The council may hold other such meetings as
6the council may determine necessary, or as required by section
7267.6. No An action taken by the council shall not be valid
8unless agreed to by a majority of the council members.
   93.  a.  Make By the beginning of each fiscal year, make
10 recommendations to the Iowa state university college of
11veterinary medicine concerning the application expenditure of
12funds appropriated to the college of veterinary medicine moneys
13in the fund
.
   14b.  The Iowa state university college of veterinary medicine
15shall not expend any of the funds appropriated by this chapter
16 until the recommendation of the council concerning that
17appropriation is adopted or sixty days following the effective
18date of the appropriation, whichever is earlier
 The college of
19veterinary medicine shall not obligate moneys in the fund for
20a fiscal year until the council makes timely recommendations
21for the expenditure of those moneys for that fiscal year as
22required in paragraph “a”

   234.  File an annual report with the secretary of agriculture.
24   Sec. 5.  Section 267.7, Code 2023, is amended to read as
25follows:
   26267.7  Other funds moneys.
   27In addition to the funds appropriated to it by this chapter
28
 moneys in the fund, the Iowa state university college of
29veterinary medicine may accept grants, gifts, matching funds
30
 moneys, or any other funds moneys for research into the
31diseases of affecting livestock. The moneys may be from any
32source, public or private.
33   Sec. 6.  Section 267.8, Code 2023, is amended to read as
34follows:
   35267.8  Livestock disease research fund.

   1There is created in the office of the treasurer of state
2a fund to be known as the livestock disease research fund.
 3Moneys in the fund are appropriated for use by the college of
4veterinary medicine to conduct research of diseases affecting
5livestock.
Any balance in said fund on June 30 of each fiscal
6year shall revert to the general fund.
7   Sec. 7.  REPEAL.  Section 267.4, Code 2023, is repealed.
8EXPLANATION
9The inclusion of this explanation does not constitute agreement with
10the explanation’s substance by the members of the general assembly.
   11BACKGROUND. This bill amends provisions in Code chapter
12267 which establishes and provides for the administration of
13the livestock health advisory council (council) which meets
14twice each year and provides recommendations to the Iowa state
15university of science and technology’s college of veterinary
16medicine (college). The board includes members appointed by
17organizations of livestock producers (member organizations),
18including cattle, swine, sheep, poultry, and milk. One
19member is a practicing member of the Iowa veterinary medical
20association. The college’s research into diseases affecting
21livestock is supported by the livestock disease research fund
22(fund) which may be appropriated moneys by the general assembly
23(see, e.g., 2022 Iowa Acts, chapter 1147, section 22).
   24BILL’S PROVISIONS. The bill changes the name of the member
25organization appointing a poultry producer and adds a member
26organization appointing a turkey producer. The bill provides
27that the council is to meet at Iowa state university rather
28than the department of agriculture and land stewardship. A
29member is not entitled to receive compensation or expenses.
30The purpose of the council is to support research of livestock
31diseases, and it must make its recommendations to the college
32by the first day of the fiscal year (July 1 through June 30).
33The college is expressly authorized to use moneys in the fund
34to conduct research of diseases affecting livestock.
