2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. NEW SECTION. 335.36 Rock blasting — setbacks.
2A county shall require operations that involve rock blasting
3to conduct such rock blasting no less than five hundred feet
4from the property line. However, a county shall not enact a
5setback requirement greater than five hundred feet for rock
6blasting activities.
7 Sec. 2. NEW SECTION. 414.34 Rock blasting — setbacks.
8A city shall require operations that involve rock blasting
9to conduct such rock blasting no less than five hundred feet
10from the property line. However, a city shall not enact a
11setback requirement greater than five hundred feet for rock
12blasting activities.
13EXPLANATION
14The inclusion of this explanation does not constitute agreement with
15the explanation’s substance by the members of the general assembly.
16This bill requires counties and cities to require operations
17that involve rock blasting to conduct such rock blasting no
18less than 500 feet from the property line. However, the
19bill prohibits counties and cities from enacting a setback
20requirement greater than 500 feet for rock blasting activities.
