3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 455B.172, subsection 11, paragraph
2a, Code 2023, is amended by adding the following new
3subparagraphs:
4 NEW SUBPARAGRAPH. (13) A change in the business entity
5owning the property if such change results in the same
6persons or immediate family members of such persons owning
7the property. For purposes of this subparagraph, “immediate
8family member” means a spouse, child, stepchild, brother,
9brother-in-law, stepbrother, sister, sister-in-law, stepsister,
10parent, parent-in-law, or stepparent.
11 NEW SUBPARAGRAPH. (14) The subdivision of a property that
12was previously held jointly.
13EXPLANATION
14The inclusion of this explanation does not constitute agreement with
15the explanation’s substance by the members of the general assembly.
16This bill relates to the inspection of a private sewage
17disposal system for certain transactions. Under current law,
18if a building where a person resides, congregates, or is
19employed is served by a private sewage disposal system, the
20sewage disposal system serving the building shall be inspected
21prior to any transfer of ownership of the building. The bill
22provides two exceptions to the definition of “transfer”. Under
23the bill, a transfer does not include a change in the business
24entity owning the property if such change results in the same
25persons or immediate family members of such persons owning the
26property, nor does a transfer include the subdivision of a
27property that was previously held jointly.
