4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  261.86B  United States army reserve
2service scholarship program.
   31.  A United States army reserve service scholarship program
4is established to be administered by the college student aid
5commission for members of the reserve forces of the United
6States army who are enrolled as undergraduate students in an
7Iowa community college, an institution of higher learning under
8the control of the state board of regents, or an accredited
9private institution as defined in section 261.9. The college
10student aid commission shall adopt rules pursuant to chapter
1117A to administer this section. An individual is eligible for
12the United States army reserve service scholarship program if
13the individual meets all of the following conditions:
   14a.  Is a resident of the state and a member of a United
15States army reserve unit while receiving scholarship award
16payments issued pursuant to this section.
   17b.  Satisfactorily completed required initial active duty
18training.
   19c.  Maintains satisfactory performance of duty upon return
20from initial active duty training.
   21d.  Is enrolled as an undergraduate student in a community
22college as defined in section 260C.2, an institution of higher
23learning under the control of the state board of regents, or an
24accredited private institution as defined in section 261.9, and
25maintains satisfactory academic progress.
   26e.  Completes and submits application forms required by the
27college student aid commission, including the free application
28for federal student aid, and applies for all nonrepayable state
29and federal financial aid for which the member is eligible.
   30f.  Is certified by the United States army administration,
31or another appropriate entity, as meeting the requirements of
32this section.
   332.  Scholarship awards paid pursuant to this section
34shall not exceed the resident tuition rate established for
35institutions of higher learning under the control of the
-1-1state board of regents. If the amount appropriated in a
2fiscal year for purposes of this section is insufficient to
3provide scholarships to all who apply for the program and who
4are determined to be eligible for the program pursuant to
5subsection 1, paragraph “f”, the college student aid commission
6shall determine the distribution of scholarships. Eligibility
7and scholarship award determinations shall not be based upon a
8member’s unit or the location at which drills are attended.
   93.  a.  Except as provided for in paragraph “b”, an eligible
10member of the United States army reserves, attending an
11institution as provided in subsection 1, paragraph “d”, shall
12not receive scholarship awards under this section for more than
13one hundred twenty semester, or the equivalent, credit hours
14of undergraduate study.
   15b.  An eligible member of the United States army reserves,
16attending an institution as provided in subsection 1,
17paragraph “d”, who is enrolled in a program of education
18leading to a postsecondary degree that meets the eligibility
19requirements for the federal Edith Nourse Rogers STEM
20scholarship established under 38 U.S.C.§3320, shall not
21receive scholarship awards issued under this section for more
22than one hundred thirty semester, or the equivalent, credit
23hours of undergraduate study.
   24c.  Except as provided for in paragraph “b”, an eligible
25member of the United States army reserves shall not receive
26scholarship awards for more than one hundred twenty semester
27hours combined between the United States army reserve service
28scholarship program established pursuant to this section and
29the national guard service scholarship established pursuant to
30section 261.86.
   31d.  A United States army reserve member who has met the
32educational requirements for a baccalaureate degree is
33ineligible for a scholarship award under this section.
   344.  The eligibility of applicants shall be certified by
35the United States army administration or another appropriate
-2-1entity. Awards under this section shall be paid to the
2community college, accredited private institution, or
3institution of higher learning under the control of the state
4board of regents by the college student aid commission upon
5receipt of certification by the educational institution as to
6accuracy of charges made and as to the attendance and academic
7progress of the individual at the educational institution.
8The college student aid commission shall maintain an annual
9record of the number of participants and the dollar value of
10the awards issued.
   115.  Scholarships awarded under this section may be used by
12the recipient for the recipient’s cost of attendance as defined
13in Tit.IV, pt.B, of the federal Higher Education Act of 1965,
14as amended.
   156.  Notwithstanding section 8.33, moneys appropriated
16for purposes of this section which remain unencumbered or
17unobligated at the close of the fiscal year for which the funds
18were appropriated shall not revert but shall be available for
19expenditure for the following fiscal year for purposes of this
20section.
21   Sec. 2.  CODE EDITOR DIRECTIVE.  The Code editor shall
22designate section 261.86B, as enacted in this Act, as a new
23section within chapter 261, subchapter IX, and may redesignate
24the preexisting subchapter and correct internal references as
25necessary, including references to subchapter headnotes.
26EXPLANATION
27The inclusion of this explanation does not constitute agreement with
28the explanation’s substance by the members of the general assembly.
   29This bill establishes the United States army reserve service
30scholarship program within the college student aid commission
31to provide scholarships to certain members of the reserve
32forces of the United States army. The bill provides that an
33individual is eligible for a scholarship under the program if
34the individual is a resident of the state and a member of a
35United States army reserve unit while receiving scholarship
-3-1award payments; satisfactorily completed required initial
2active duty training; maintains satisfactory performance
3of duty upon return from initial active duty training; is
4enrolled as an undergraduate student in a community college
5in this state, an institution of higher learning under the
6control of the state board of regents, or an accredited
7private institution, and maintains satisfactory academic
8progress; completes and submits application forms required
9by the commission and applies for all nonrepayable state and
10federal financial aid for which the member is eligible; and is
11certified as meeting the requirements under the program.
   12The bill provides that scholarship awards under the program
13shall not exceed the resident tuition rate established for
14institutions of higher learning under the control of the state
15board of regents. If the amount appropriated in a fiscal
16year for purposes of the program is insufficient to provide
17scholarships to all who apply for and are eligible for the
18program, the commission shall determine the distribution of
19scholarships.
   20The bill prohibits an eligible member of the United
21States army reserves from receiving scholarship awards
22under the program for more than 120 semester credit hours
23of undergraduate study. However, an eligible member of the
24United States army reserves who is enrolled in a program of
25education leading to a postsecondary degree that meets the
26eligibility requirements for the federal Edith Nourse Rogers
27STEM scholarship may receive scholarship awards under the
28program for 130 semester credit hours of undergraduate study.
29The bill establishes limits on the amount of scholarship awards
30for eligible members who receive scholarship awards under the
31program and the national guard service scholarship program. A
32United States army reserve member who has met the educational
33requirements for a baccalaureate degree is ineligible for a
34scholarship award under the program.
   35Awards under the program shall be paid to the educational
-4-1institution by the commission upon receipt of certification by
2the educational institution as to accuracy of charges made and
3as to the attendance and academic progress of the individual
4at the educational institution. The commission must maintain
5an annual record of the number of participants and the dollar
6value of the awards issued under the program.
   7Scholarships awarded under the program may be used by the
8recipient for the recipient’s cost of attendance as defined in
9the federal Higher Education Act of 1965.
