4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 249A.29, subsection 1, Code 2023, is
2amended to read as follows:
   31.  For purposes of this section and section 249A.30 unless
4the context otherwise requires:
   5a.  “Consumer” means an individual approved by the department
6to receive services under a waiver.
   7b.  “Provider” means an agency certified by the department to
8provide services under a waiver.
   9c.  “Services” means services provided under a waiver
10including but not limited to habilitation services, the program
11of all-inclusive care for the elderly services, home health
12services, hospice services, targeted case management, and money
13follows the person services.
   14c.    d.  “Waiver” means a home and community-based services
15waiver approved by the federal government and implemented under
16the medical assistance program.
17   Sec. 2.  Section 335.34, subsection 4, Code 2023, is amended
18to read as follows:
   194.  For the purposes of this section, “home and
20community-based services waiver”
:
   21a.   “Home and community-based services waiver”means “waiver”
22as defined in section 249A.29.
   23b.  “Services” means services as defined in section 249A.29.
24   Sec. 3.  Section 414.32, subsection 4, Code 2023, is amended
25to read as follows:
   264.  For the purposes of this section, “home and
27community-based services waiver”
:
   28a.   “Home and community-based services waiver”means “waiver”
29as defined in section 249A.29.
   30b.  “Services” means services as defined in section 249A.29.
31EXPLANATION
32The inclusion of this explanation does not constitute agreement with
33the explanation’s substance by the members of the general assembly.
   34This bill provides that, relative to Medicaid home and
35community-based services (HCBS) waiver services and providers
-1-1including city and county zoning requirements applicable to
2HCBS waiver recipient residences, “services” under a Medicaid
3HCBS waiver include but are not limited to habilitation
4services, the program of all-inclusive care for the elderly
5services, home health services, hospice services, targeted case
6management, and money follows the person services.
