4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  453A.13A  Inspections of violations
2of retailers.
   3As a condition for issuance of a permit to, and as a
4condition of the continued holding of a valid permit by,
5a retailer as defined in sections 453A.1 and 453A.42, the
6applicant or holder must give consent to members of the fire,
7police, and health departments and the building inspector of
8cities; the county sheriff or deputy sheriff; members of the
9department of public safety; representatives of the department
10of revenue and of the department of inspections and appeals;
11certified police officers; and any official county health
12officer to enter upon areas of the premises where cigarettes,
13tobacco, tobacco products, alternative nicotine products, or
14vapor products are possessed, stored, offered for sale, sold,
15or otherwise distributed to consumers without a warrant during
16business hours of the permittee to inspect for violations of
17this chapter or ordinances and regulations that cities and
18boards of supervisors may adopt.
19EXPLANATION
20The inclusion of this explanation does not constitute agreement with
21the explanation’s substance by the members of the general assembly.
   22This bill provides that as a condition of issuance of a
23permit to, and as a condition of the continued holding of a
24valid permit by, a retailer, the applicant or holder must give
25consent to members of the fire, police, and health departments
26and the building inspector of cities; the county sheriff or
27deputy sheriff; members of the department of public safety;
28representatives of the department of revenue and the department
29of inspections and appeals; certified police officers; and
30any official county health officer to enter upon areas of
31the premises where cigarettes, tobacco, tobacco products,
32alternative nicotine products, or vapor products are possessed,
33stored, offered for sale, sold, or otherwise distributed to
34consumers without a warrant during business hours of the
35permittee to inspect for violations of Code chapter 453A
-1-1(cigarettes and tobacco taxes and regulation of alternative
2nicotine products and vapor products) or ordinances and
3regulations that cities and boards of supervisors may adopt.
4For the purposes of the bill, “retailer” includes both persons
5in this state who sell, distribute, or offer for sale for
6consumption or possess for the purpose of sale for consumption,
7cigarettes, alternative nicotine products, or vapor products;
8and persons in the business of selling tobacco, tobacco
9products, alternative nicotine products, or vapor products to
10ultimate consumers.
