4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  49.106  Records preserved.
   21.  At the conclusion of each election, the state
3commissioner of elections shall create a record containing all
4information in the statewide voter registration database at the
5time of the election for each voter who voted in the election.
6The state commissioner of elections shall maintain this record
7for twenty-two months.
   82.  A record created pursuant to this section shall be made
9available in an electronic format at no cost upon request,
10except that if the record is too large to be transmitted
11electronically, the requester shall provide a device to store
12the record.
13   Sec. 2.  NEW SECTION.  52.39  Ballot logs.
   141.  Each commissioner shall create a log of each vote cast in
15the county for each primary and general election, which must be
16in the form of a text, comma, or tab delimited file organized
17in the order in which ballots were processed. The log must
18include all of the following information for each ballot cast
19in the county, if available:
   20a.  The sequential identification number.
   21b.  The timestamp.
   22c.  The method by which the ballot was cast.
   23d.  The candidates for whom the ballot was marked.
   24e.  Batch identification number.
   25f.  Tabulator identification number.
   262.  A log created pursuant to this section shall not include
27personally identifiable information for any ballot, including a
28voter’s name, voter identification number, or address.
   293.  To the extent possible, data in the log shall be made
30available on a per precinct basis.
   314.  A log created pursuant to this section shall be made
32available in an electronic format at no cost upon request,
33except that if the log is too large to be transmitted
34electronically, the requester shall provide a device to store
35the log.

   15.  A log created pursuant to this section shall be
2maintained for twenty-two months after the election for which
3the log was created.
   46.  The state commissioner of elections shall adopt rules
5pursuant to chapter 17A to implement this section.
6EXPLANATION
7The inclusion of this explanation does not constitute agreement with

   9This bill relates to records created and retained by the
10state commissioner of elections and county commissioners
11of elections. The bill requires the state commissioner of
12elections to create a record containing all information in
13the statewide voter registration database at the time of an
14election for each voter who voted in that election. The state
15commissioner of elections shall maintain the record for 22
16months. A person may request an electronic copy of the record
17at no cost.
   18The bill also requires each county commissioner of elections
19to create a log of each ballot cast at each primary and general
20election in the form of a text, comma, or tab delimited file.
21The log must include, to the extent possible, each ballot’s
22sequential identification number, timestamp, method of voting,
23selection of candidates, batch identification number, and
24tabulator identification number. The log shall not include
25any personally identifiable information for a voter. The bill
26requires the data in the log to be made available on a per
27precinct basis if possible. A person may request an electronic
28copy of a log at no cost, and a log shall be maintained for 22
29months following the election for which the log was created.
