3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  327D.6  Lighted lamps required.
   2A railroad train, as defined in section 321.1, shall display
3lighted lamps when operated at any time from sunset to sunrise.
4However, a lighted lamp shall not be displayed inside the cabin
5if such lamp would harm the vision of the engineer, conductor,
6brake operator, or any other member of the crew of a railroad
7train while operating the railroad train.
8EXPLANATION
9The inclusion of this explanation does not constitute agreement with
10the explanation’s substance by the members of the general assembly.
   11Code chapter 327D provides for the regulation of carriers.
   12This bill requires a railroad train to display lighted lamps
13when operated at any time from sunset to sunrise. However,
14displaying a lighted lamp is prohibited inside the cabin if
15such lamp would harm the vision of the engineer, conductor,
16brake operator, or any other member of the crew of a railroad
17train while operating the railroad train. Under Code section
18321.1, “railroad train” means an engine or locomotive with or
19without cars coupled thereto, operated upon rails.
   20Pursuant to Code section 327D.17, a violation of the bill is
21a simple misdemeanor punishable as a schedule “four” penalty
22under Code section 327C.5, a fine of not less than $500 nor
23more than $5,000 per violation. In addition, if a violation
24results in injury to a person, the person may demand in
25writing, as provided in accordance with Code section 327D.16,
26that such a violation result in treble damages, attorney fees,
27and costs.
