3enrolled in a school district or charter school.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 256E.7, subsection 2, Code 2023, is
2amended by adding the following new paragraph:
3   NEW PARAGRAPH.  0j.  Be subject to and comply with the
4requirements of section 279.77 relating to prohibited actions
5associated with the gender identity of students in the same
6manner as a school district.
7   Sec. 2.  NEW SECTION.  279.77  Gender identity — parental or
8guardian consent — prohibitions.
   9Each school district is prohibited from doing any of the
10following:
   111.  Facilitating any accommodation that is intended to
12affirm a student’s gender identity, if that gender identity
13is different than the sex listed on the student’s official
14birth certificate or certificate issued upon adoption if the
15certificate was issued at or near the time of the student’s
16birth, without the written consent of the student’s parent or
17guardian. For purposes of this section, “gender identity” means
18the same as defined in section 216.2.
   192.  Encouraging or coercing any student to withhold
20information from the student’s parent or guardian related to
21the student’s gender identity.
   223.  Willfully withholding information from, or knowingly
23giving false or misleading information to, the parent or
24guardian of a student regarding the student’s gender identity
25or intention to transition to a gender that is different than
26the sex listed on a student’s official birth certificate or
27certificate issued upon adoption if the certificate was issued
28at or near the time of the student’s birth.
   294.  Encouraging, pressuring, or coercing a student to
30undergo any medical procedure, treatment, or intervention that
31is designed to affirm the student’s gender identity if that
32gender identity is different than the sex listed on a student’s
33official birth certificate or certificate issued upon adoption
34if the certificate was issued at or near the time of the
35student’s birth.

   15.  Encouraging, pressuring, or coercing a student’s
2parent or guardian to allow the student to undergo any medical
3procedure, treatment, or intervention that is designed to
4affirm the student’s gender identity if that gender identity
5is different than the sex listed on the student’s official
6birth certificate or certificate issued upon adoption if the
7certificate was issued at or near the time of the student’s
8birth.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
   12This bill relates to parental and guardian consent and
13information regarding the gender identity of students enrolled
14in a school district or charter school.
   15The bill prohibits school districts and charter schools
16from facilitating any accommodation that is intended to
17affirm a student’s gender identity, if that gender identity
18is different than the sex listed on the student’s official
19birth certificate, without the written consent of the student’s
20parent or guardian; encouraging or coercing any student to
21withhold information from the student’s parent or guardian
22related to the student’s gender identity; willfully withholding
23information from, or knowingly giving false or misleading
24information to, the parent or guardian of a student regarding
25the student’s gender identity or intention to transition to a
26gender that is different than the sex listed on a student’s
27official birth certificate; encouraging, pressuring, or
28coercing a student to undergo any medical procedure, treatment,
29or intervention that is designed to affirm the student’s
30gender identity if that gender identity is different than
31the sex listed on a student’s official birth certificate;
32or encouraging, pressuring, or coercing a student’s parent
33or guardian to allow the student to undergo any medical
34procedure, treatment, or intervention that is designed to
35affirm the student’s gender identity if that gender identity is

   3The bill defines “gender identity” as a gender-related
4identity of a person, regardless of the person’s assigned sex
5at birth.
