4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 148.6, subsection 2, Code 2023, is
2amended by adding the following new paragraph:
3 NEW PARAGRAPH. i. Receiving or agreeing to receive a
4commission, rebate, remuneration, or other financial gain in
5exchange for the promotion of, referral of a patient for, or
6the selling, prescribing, dispensing, or administering of, a
7particular drug or device for other than legal and legitimate
8therapeutic purposes.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
12This bill includes in the acts or offenses for which the
13board of medicine may discipline a licensee, the receiving or
14agreeing to receive a commission, rebate, remuneration, or
15other financial gain in exchange for the promotion of, referral
16of a patient for, or the selling, prescribing, dispensing, or
17administering of, a particular drug or device for other than
18legal and legitimate therapeutic purposes. Under Code section
19148.6, licensee discipline may include a civil penalty not to
20exceed $10,000.
