4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  DEPARTMENT OF HEALTH AND HUMAN SERVICES — CHILD
2CARE CENTERS — LIABILITY INSURANCE.
  The department of health
3and human services shall promulgate rules pursuant to chapter
417A to require a child care center that employs a person under
5the age of eighteen who provides child care or substitute child
6care to school-age children without additional supervision
7to provide documentation of professional liability insurance
8coverage for such employees. For the purposes of this section,
9“child care” and “child care center” mean the same as defined
10in section 237A.1.
11EXPLANATION
12The inclusion of this explanation does not constitute agreement with
13the explanation’s substance by the members of the general assembly.
   14This bill relates to professional liability insurance by
15child care centers employing unsupervised child care workers
16under 18 years of age.
   17The bill requires the department of health and human
18services to promulgate rules to require a child care center
19that employs a person under 18 years of age who provides child
20care or substitute child care to school-age children without
21additional supervision to provide documentation of professional
22liability insurance coverage for such employees. For the
23purposes of the bill, “child care” and “child care center” mean
24the same as defined in Code section 237A.1.
