3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  455B.103B  Natural resource use
2permits.
   3The director may issue up to ten natural resource use permits
4each year that authorize economic development projects to use
5or encroach on property managed or owned by the department. An
6economic development project must promote the natural resources
7of the state. The extent of the economic development project’s
8use or encroachment shall not exceed one hundred square feet.
9A permit issued under this section is valid for six months and
10cannot be extended. The economic development project shall
11not damage the property managed or owned by the department and
12evidence of the use or encroachment shall not be visible on the
13property after one year from the expiration of the permit.
14EXPLANATION
15The inclusion of this explanation does not constitute agreement with
16the explanation’s substance by the members of the general assembly.
   17This bill relates to the issuance of a natural resource
18use permit (permit). The bill authorizes the director of
19the department of natural resources (DNR) to issue up to 10
20permits each year that authorize economic development projects
21(project) to use or encroach on property managed or owned by
22DNR. A project must promote the natural resources of the
23state. A project’s use or encroachment shall not exceed 100
24square feet of the property managed or owned by DNR. A permit
25is valid for six months and cannot be extended. A project
26shall not damage the property and evidence of the use or
27encroachment shall not be visible on the property after one
28year from the expiration of the permit.
   29By operation of law, a person who violates a permit issued
30under the bill is subject to civil enforcement procedures,
31including penalties, adopted by the environmental protection
32commission.
