4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 257.11, subsection 5, Code 2023, is
2amended to read as follows:
   35.  Shared operational functions — increased student
4opportunities — budget years beginning in 2014 through 2024

 2034.
   6a.  (1)  In order to provide additional funding to increase
7student opportunities and redirect more resources to student
8programming for school districts that share operational
9functions, a district that shares with a political subdivision
10one or more operational functions of a curriculum director,
11master social worker, independent social worker, work-based
12learning coordinator, special education director, mental health
13professional who holds a statement of recognition issued by the
14board of educational examiners, college and career transition
15counselor or coordinator, school resource officer, or school
16counselor, or one or more operational functions in the areas
17of superintendent management, business management, human
18resources, transportation, or operation and maintenance for at
19least twenty percent of the school year shall be assigned a
20supplementary weighting for each shared operational function.
21A school district that shares an operational function in
22the area of superintendent management shall be assigned a
23supplementary weighting of nine pupils for the function. A
24school district that shares an operational function in the area
25of business management, human resources, transportation, or
26operation and maintenance shall be assigned a supplementary
27weighting of five pupils for the function. A school district
28that shares the operational functions of a curriculum director;
29a master social worker or an independent social worker licensed
30under chapters 147 and 154C; a work-based learning coordinator;
31a special education director; a mental health professional
32who holds a statement of recognition issued by the board
33of educational examiners; a college and career transition
34counselor or coordinator; a school resource officer; or a
35school counselor shall be assigned a supplementary weighting of
-1-1three pupils for the function. The additional weighting shall
2be assigned for each discrete operational function shared.
3However, a school district may receive the additional weighting
4under this subsection for sharing the services of an individual
5with a political subdivision or another school district even if
6the type of operational function performed by the individual
7for the school district and the type of operational function
8performed by the individual for the political subdivision or
9another school district are not the same operational function,
10so long as either both operational functions are eligible for
11weighting under this subsection or the operational function
12the individual performs for the school district is special
13education director. In either case, the school district
14shall be assigned the additional weighting for the type of
15operational function that the individual performs for the
16school district, and the school district shall not receive
17additional weighting for any other function performed by the
18individual. The operational function sharing arrangement does
19not need to be a newly implemented sharing arrangement to
20receive supplementary weighting under this subsection.
   21(2)  For the purposes of this paragraph “a”:
   22(a)  “College and career transition counselor or coordinator”
23means a licensed school counselor or an appropriately trained
24individual responsible for providing direct services to
25students, parents, families, schools, and postsecondary
26institutions to support college preparation and postsecondary
27success, such as college preparation, financial aid processing,
28and transition to postsecondary institution enrollment.
   29(b)  “Political subdivision” means a city, township, county,
30school corporation, merged area, area education agency,
31institution governed by the state board of regents, or any
32other governmental subdivision.
   33(c)  “School resource officer” means the same as defined in
3434 U.S.C. §10389.
   35(d)  “Work-based learning coordinator” means an appropriately
-2-1trained individual responsible for facilitating authentic,
2engaging work-based learning experiences for learners and
3educators in partnership with employers and others to enhance
4learning by connecting the content and skills that are
5necessary for future careers.
   6b.  (1)  Notwithstanding paragraph “a”, subparagraph (1),
7each operational function assigned a supplementary weighting
8of five pupils under paragraph “a”, subparagraph (1), shall
9instead be assigned a supplementary weighting of four pupils
10for the school budget years beginning on or after July 1, 2022,
11July 1, 2023, and July 1, 2024 but before July 1, 2035.
   12(2)  Notwithstanding paragraph “a”, subparagraph (1), each
13operational function assigned a supplementary weighting of
14three pupils under paragraph “a”, subparagraph (1), shall
15instead be assigned a supplementary weighting of two pupils for
16the school budget years beginning on or after July 1, 2022,
17July 1, 2023, and July 1, 2024 but before July 1, 2035.
   18c.  School districts that share operational functions with
19other school districts are not required to be contiguous school
20districts. If two or more districts sharing operational
21functions are not contiguous to each other, the districts
22separating those districts are not required to be a party to
23the operational functions sharing arrangement.
   24d.  Supplementary weighting pursuant to this subsection shall
25be available to a school district during the period commencing
26with the budget year beginning July 1, 2014, through the
27budget year beginning July 1, 2024 2034. The maximum amount
28of additional weighting for which a school district shall be
29eligible in a budget year is twenty-one additional pupils.
30Criteria for determining the qualification of operational
31functions for supplementary weighting shall be determined by
32the department by rule, through consideration of increased
33student opportunities.
   34e.  Supplementary weighting pursuant to this subsection shall
35be available to an area education agency during the period
-3-1commencing with the budget year beginning July 1, 2014, through
2the budget year beginning July 1, 2024 2034. The minimum
3amount of additional funding for which an area education
4agency shall be eligible in a budget year is thirty thousand
5dollars, and the maximum amount of additional funding for which
6an area education agency shall be eligible is two hundred
7thousand dollars. The department of management shall annually
8set a weighting for each area education agency to generate
9the approved operational sharing expense using the area
10education agency’s special education cost per pupil amount and
11foundation level. Criteria for determining the qualification
12of operational functions for supplementary weighting shall be
13determined by the department by rule, through consideration of
14increased student opportunities.
   15f.  This subsection is repealed effective July 1, 2025 2035.
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
   19Code section 257.11(5) provides supplementary weighting
20for school districts and area education agencies that share
21specified operational functions with another political
22subdivision of this state. Supplementary weighting under
23this provision is available for school budget years beginning
24on or after July 1, 2014, through the budget year beginning
25July 1, 2024. This bill extends the period of years for the
26supplementary weighting through the budget year beginning July
271, 2034.
