House Study Bill 59 - IntroducedA Bill ForAn Act 1An Act relating to service credit for military service
2under the Iowa Public Employees’ Retirement System.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 97B.80, Code 2023, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  1A.  Effective July 1, 2023, a vested or
4retired member who has one or more full calendar years of
5covered wages and who at any time served on active duty in the
6armed forces of the United States, upon submitting verification
7of the dates of the active duty service, shall receive credit
8for membership service and prior service for the period of
9time of the active duty service, in increments of one or more
10calendar quarters, up to a maximum of sixteen quarters of
11membership service and prior service.
12   Sec. 2.  Section 97B.80, subsection 2, unnumbered paragraph
131, Code 2023, is amended to read as follows:
   14The contributions required to be made pursuant to subsection

for purposes of this section shall be determined as follows:
16   Sec. 3.  Section 97B.80, subsections 3 and 4, Code 2023, are
17amended to read as follows:
   183.  Verification of active duty service and payment of
19contributions, if required, shall be made to the system.
20However, a member is not eligible to make contributions receive
21credit for membership service and prior service
under this
22section if the member is receiving, is eligible to receive,
23or may in the future be eligible to receive retirement pay
24from the United States government for active duty in the armed
25forces, except for retirement pay granted by the United States
26government under retired pay for nonregular service pursuant to
2710 U.S.C. §12731 – 12739. A member receiving retired pay for
28nonregular service who makes contributions submits verification
29of active duty service
under this section shall provide
30information required by the system documenting time periods
31covered under retired pay for nonregular service.
   324.  a.  Effective July 1, 2004, a member eligible for an
33increased retirement allowance because of the payment of
34contributions pursuant to subsection 1 under this section is
35entitled to adjusted payments beginning with the month in which
-1-1the member pays contributions under this section.
   2b.  Effective July 1, 2023, a member eligible for an
3increased retirement allowance pursuant to subsection 1A is
4entitled to adjusted payments beginning with the month in which
5the system verifies the dates of the active duty service of the
6member.
7EXPLANATION
8The inclusion of this explanation does not constitute agreement with
9the explanation’s substance by the members of the general assembly.
   10This bill relates to receiving veteran’s credit under the
11Iowa Public Employees’ Retirement System (IPERS).
   12The bill provides that a vested or retired member under IPERS
13who at anytime submits verification of service on active duty
14in the armed forces of the United States shall receive credit
15for membership service and prior service for the active duty
16service up to a maximum of four years of service credit upon
17submitting verification of the dates of the military service.
18Unlike current law, the bill provides that the IPERS member
19shall receive credit for the active duty service without the
20requirement of making contributions for that service to the
21retirement system.
