3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 96.3, Code 2023, is amended by adding the
2following new subsection:
3   NEW SUBSECTION.  5A.  Diminished salary offset.  If an
4individual receiving benefits accepts an offer of employment
5prior to the exhausting of all benefits for the individual’s
6benefit year and the gross weekly salary is less than the
7individual’s weekly benefit amount, the individual shall be
8eligible to receive an amount equal to the difference between
9the individual’s gross weekly salary and the individual’s
10weekly benefit amount. Benefits shall be exhausted when the
11individual’s gross weekly salary paid plus benefits received
12equal or are greater than the maximum total amount of benefits
13payable to the individual during the benefit year.
14EXPLANATION
15The inclusion of this explanation does not constitute agreement with
16the explanation’s substance by the members of the general assembly.
   17This bill establishes a diminished salary offset for
18unemployment benefits whereby an individual who accepts
19employment with a gross weekly salary less than the
20individual’s weekly unemployment benefit amount may receive an
21amount equal to the difference between the individual’s gross
22weekly salary and the individual’s weekly benefit amount if
23the individual accepts such employment prior to exhausting the
24individual’s benefits for the individual’s benefit year. The
25individual’s benefits shall be exhausted when the individual’s
26gross weekly salary paid plus benefits received are equal to or
27greater than the maximum total amount of benefits payable to
28the individual during the benefit year.
