8BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2EDUCATION FUNDING — MONTHLY INSTALLMENTS
3   Section 1.  Section 257.16, subsection 2, Code 2022, is
4amended to read as follows:
   52.  All state aids paid under this chapter, unless otherwise
6stated and to the extent practicable, shall be paid in monthly
7installments beginning on September July 15 of a budget year
8and ending on or about June 15 of the budget year as determined
9by the department of management, taking into consideration the
10relative budget and cash position of the state resources and
11the enactment date of legislation determining aid amounts
.
12   Sec. 2.  Section 257.35, subsection 1, Code 2022, is amended
13to read as follows:
   141.  The department of management shall deduct the amounts
15calculated for special education support services, media
16services, area education agency teacher salary supplement
17district cost, area education agency professional development
18supplement district cost, and educational services for each
19school district from the state aid due to the district pursuant
20to this chapter and shall pay the amounts to the respective
21area education agencies on a monthly basis from September 15
22through June 15 during each school year
 as determined by the
23department of management in the same manner as provided under
24section 257.16, subsection 2
. The department of management
25shall notify each school district of the amount of state aid
26deducted for these purposes and the balance of state aid shall
27be paid to the district. If a district does not qualify for
28state aid under this chapter in an amount sufficient to cover
29its amount due to the area education agency as calculated by
30the department of management, the school district shall pay
31the deficiency to the area education agency from other moneys
32received by the district, on a quarterly basis during each
33school year.
34   Sec. 3.  Section 282.31, subsection 1, paragraph a, Code
352022, is amended to read as follows:
-1-   1a.  A child who lives in a facility pursuant to section
2282.30, subsection 1, paragraph “a”, and who is not enrolled
3in the educational program of the district of residence of
4the child, shall receive appropriate educational services.
5The area education agency shall submit a proposed program and
6budget to the department of education by January 1 for the next
7succeeding school year. The department of education shall
8review and approve or modify the program and proposed budget
9and shall notify the department of administrative services
10and the area education agency of its action by February
111. The department of administrative services shall pay the
12approved budget amount for an area education agency in monthly
13installments beginning September 15 and ending June 15 of the
14next succeeding school year
 as determined by the department of
15management in the same manner as provided under section 257.16,
16subsection 2
. The installments shall be as nearly equal as
17possible as determined by the department of management, taking
18into consideration the relative budget and cash position of
19the state’s resources and the enactment date of legislation
20determining such amounts
. The department of administrative
21services shall transfer the approved budget amount for an area
22education agency from the moneys appropriated under section
23257.16 and make the payment to the area education agency. The
24area education agency shall submit an accounting for the actual
25cost of the program to the department of education by August
261 of the following school year. The department shall review
27and approve or modify all expenditures incurred in compliance
28with the guidelines pursuant to section 256.7, subsection 10,
29and shall notify the department of administrative services of
30the approved accounting amount. The approved accounting amount
31shall be compared with any amounts paid by the department of
32administrative services to the area education agency and any
33differences added to or subtracted from the October payment
34made under this paragraph for the next school year. Any amount
35paid by the department of administrative services shall be
-2-1deducted monthly from the state foundation aid paid under
2section 257.16 to all school districts in the state during the
3subsequent fiscal year. The portion of the total amount of the
4approved budget that shall be deducted from the state aid of a
5school district shall be the same as the ratio that the budget
6enrollment for the budget year of the school district bears to
7the total budget enrollment in the state for that budget year
8in which the deduction is made.
9   Sec. 4.  Section 282.33, subsection 1, Code 2022, is amended
10to read as follows:
   111.  A child who resides in an institution for children under
12the jurisdiction of the director of human services referred
13to in section 218.1, subsection 3, 4, 5, or 6, and who is
14not enrolled in the educational program of the district of
15residence of the child, shall receive appropriate educational
16services. The institution in which the child resides shall
17submit a proposed program and budget based on the average
18daily attendance of the children residing in the institution
19to the department of education and the department of human
20services by January 1 for the next succeeding school year. The
21department of education shall review and approve or modify the
22proposed program and budget and shall notify the department
23of administrative services of its action by February 1. The
24department of administrative services shall pay the approved
25budget amount to the department of human services in monthly
26installments beginning September 15 and ending June 15 of the
27next succeeding school year
 as determined by the department of
28management in the same manner as provided under section 257.16,
29subsection 2
. The installments shall be as nearly equal as
30possible as determined by the department of administrative
31services
 management, taking into consideration the relative
32budget and cash position of the state’s resources and the
33enactment date of legislation determining such amounts
. The
34department of administrative services shall pay the approved
35budget amount for the department of human services from the
-3-1moneys appropriated under section 257.16 and the department of
2human services shall distribute the payment to the institution.
3The institution shall submit an accounting for the actual cost
4of the program to the department of education by August 1 of
5the following school year. The department shall review and
6approve or modify all expenditures incurred in compliance with
7the guidelines adopted pursuant to section 256.7, subsection
810, and shall notify the department of administrative
9services of the approved accounting amount. The approved
10accounting amount shall be compared with any amounts paid by
11the department of administrative services to the department
12of human services and any differences added to or subtracted
13from the October payment made under this subsection for
14the next school year. Any amount paid by the department of
15administrative services shall be deducted monthly from the
16state foundation aid paid under section 257.16 to all school
17districts in the state during the subsequent fiscal year. The
18portion of the total amount of the approved budget that shall
19be deducted from the state aid of a school district shall
20be the same as the ratio that the budget enrollment for the
21budget year of the school district bears to the total budget
22enrollment in the state for that budget year in which the
23deduction is made.
24   Sec. 5.  APPLICABILITY.  This division of this Act applies
25July 1, 2023, for school budget years beginning on or after
26that date.
27DIVISION II
28AREA EDUCATION AGENCY FUNDING SUPPLEMENTS
29   Sec. 6.  Section 257.10, subsections 3 and 4, Code 2022, are
30amended to read as follows:
   313.  Special education support services district cost per pupil
32for 1991-1992 2022-2023.
  For the budget year beginning July 1,
331991 2022, for the special education support services district
34cost per pupil, the department of management shall divide the
35approved budget of each area education agency for special
-4-1education support services for that year approved by the state
2board of education, under section 273.3, subsection 12, by
3the total of the weighted enrollment for special education
4support services in the area for that
 is the special education
5support services district cost per pupil for the base year plus
6the special education support services supplemental state aid
7for the
budget year. The special education support services
8district cost per pupil for each school district in an area for
9the budget year is the amount calculated by the department of
10management under this subsection.

   114.  Special education support services district cost per pupil
12for 1992-1993 2023-2024 and succeeding years.
   13a.  For the budget year beginning July 1, 1992 2023, and
14succeeding budget years, the special education support services
15district cost per pupil for the budget year is the special
16education support services district cost per pupil for the base
17year plus the special education support services supplemental
18state aid for the budget year.
   19b.  Notwithstanding the special education support services
20district cost per pupil for the budget year beginning July 1,
211991, calculated under subsection 3
 paragraph “a”, for area
22education agencies that have fewer than three and five-tenths
23
 ten public school pupils per square mile, the special education
24support services district cost per pupil for the budget year
25beginning July 1, 1991 2023and each succeeding budget year,
26 is one hundred forty-seven dollars the special education
27support services district cost per pupil for the base year plus
28the special education support services supplemental state aid
29for the budget year plus three percent of the special education
30support services state cost per pupil for the budget year
.
31   Sec. 7.  Section 257.37, subsections 1 and 3, Code 2022, are
32amended to read as follows:
   331.  a.  For the budget year beginning July 1, 1991, and
34succeeding budget years, the total amount funded in each area
35for media services shall be computed as provided in this

   2b.  For the budget year beginning July 1, 1991, the total
3amount funded in each area for media services in the base year
4shall be divided by the enrollment served in the base year
5to provide an area media services cost per pupil in the base
6year, and the department of management shall compute the state
7media services cost per pupil in the base year which is equal
8to the average of the area media services costs per pupil in
9the base year. For the budget year beginning July 1, 1991, and
10succeeding budget years, the department of management shall
11compute the supplemental state aid for media services in the
12budget year by multiplying the state media services cost per
13pupil in the base year times the state percent of growth for
14the budget year, and the. For budget years beginning on or
15after July 1, 2023, the state media services cost per pupil for
16each budget year is equal to the state media services cost per
17pupil for the base year plus the supplemental state aid for
18media services for the budget year.

   19c.  For the budget year beginning July 1, 2023, and each
20succeeding budget year, the area media services cost per pupil
21is equal to the area media services cost per pupil for the base
22year plus the supplemental state aid for media services for
23the budget year. However, for area education agencies that
24have fewer than ten public school pupils per square mile, the
25area media services cost per pupil is equal to the area media
26services cost per pupil for the base year plus the supplemental
27state aid for media services for the budget year plus three
28percent of the state media services cost per pupil for the
29budget year.
   30d.   Thetotal amount funded in each area for media services
31cost in the budget year equals the area media services cost
32per pupil in the base budget year plus the supplemental state
33aid for media services in the budget year
times the enrollment
34served in the budget year. Funds shall be paid to area
35education agencies as provided in section 257.35.

   13.  a.  For the budget year beginning July 1, 1991, and
2succeeding budget years, the total amount funded in each area
3for educational services shall be computed as provided in this
4subsection.
   5b.  For the budget year beginning July 1, 1991, the total
6amount funded in each area for educational services in the base
7year shall be divided by the enrollment served in the area in
8the base year to provide an area educational services cost
9per pupil in the base year, and the department of management
10shall compute the state educational services cost per pupil
11in the base year, which is equal to the average of the area
12educational services costs per pupil in the base year. For
13the budget year beginning July 1, 1991, and succeeding
14budget years, the department of management shall compute the
15supplemental state aid for educational services by multiplying
16the state educational services cost per pupil in the base year
17times the state percent of growth for the budget year, and
18the
. For budget years beginning on or after July 1, 2023, the
19state educational services cost per pupil for each budget year
20is equal to the state educational services cost per pupil for
21the base year plus the supplemental state aid for educational

   23c.  For the budget year beginning July 1, 2023, and each
24succeeding budget year, the area educational services cost
25per pupil is equal to the area educational services cost per
26pupil for the base year plus the supplemental state aid for
27educational services for the budget year. However, for area
28education agencies that have fewer than ten public school
29pupils per square mile, the area educational services cost
30per pupil is equal to the area educational services cost per
31pupil for the base year plus the supplemental state aid for
32educational services for the budget year plus three percent of
33the state educational services cost per pupil for the budget
34year.
   35d.   Thetotal amount funded in each area for educational

2services cost per pupil for the base budget year plus the
3supplemental state aid for educational services in the budget
4year
times the enrollment served in the area in the budget
5year. Funds shall be paid to area education agencies as
6provided in section 257.35.
7DIVISION III
8PROFESSIONAL DEVELOPMENT EXPENSES
9   Sec. 8.  NEW SECTION.  273.17  Training and professional
10development expenses.
   11Each area education agency shall include in the basic
12educational data survey information related to the training and
13professional development courses and programs provided by the
14area education agency during the current school year, including
15all of the following:
   161.  The total number of hours of required training and
17professional development courses and programs the area
18education agency provided to its employees and the total cost
19of the required training and professional development courses
20and programs.
   212.  The total number of hours of optional training and
22professional development courses and programs the area
23education agency provided to its employees and the total cost
24of the optional training and professional development courses
25and programs.
26   Sec. 9.  NEW SECTION.  279.76  Training and professional
27development expenses.
   28Each school district shall include in the basic educational
29data survey information related to the training and
30professional development courses and programs provided by the
31school district during the current school year, including all
32of the following:
   331.  The total number of hours of required training and
34professional development courses and programs the school
35district provided to its employees and the total cost of the

2programs.
   32.  The total number of hours of optional training and
4professional development courses and programs the school
5district provided to its employees and the total cost of the
6optional training and professional development courses and
7programs.
8DIVISION IV
9LEGISLATIVE INTERIM STUDY COMMITTEE — PRACTITIONER PREPARATION
10PROGRAMS
11   Sec. 10.  LEGISLATIVE INTERIM STUDY COMMITTEE — ASSESSMENT
12OF PRACTITIONER PREPARATION PROGRAMS.
   131.  The legislative council is requested to establish an
14interim study committee during the 2022 interim and 2023
15interim to assess practitioner preparation programs approved
16under section 256.7, subsection 3, including the effectiveness
17of the practitioner preparation programs in preparing teachers
18and whether the instruction provided in the practitioner
19preparation programs aligns with the needs of students in this
20state.
   212.  a.  The interim study committee shall submit an initial
22report, including preliminary findings, to the general assembly
23by December 15, 2022.
   24b.  The interim study committee shall submit a final report,
25including findings and recommendations for policy changes, to
26the general assembly by December 15, 2023.
27EXPLANATION
28The inclusion of this explanation does not constitute agreement with
29the explanation’s substance by the members of the general assembly.
   30This bill relates to education by modifying provisions
31related to the payment of state aid, calculations of
32certain area education agency supplements, and the reporting
33requirements of area education agencies and school districts,
34and by requesting the establishment of an interim study
35committee to assess practitioner preparation programs.

   1DIVISION I — EDUCATION FUNDING — MONTHLY INSTALLMENTS.
2 The bill amends Code section 257.16(2) to provide that all
3state aid paid under Code chapter 257, unless otherwise
4stated and to the extent practicable, shall be paid in monthly
5installments beginning July 15 of a budget year. Under current
6law, the payment of such monthly installments begins September
715.
   8Current Code section 257.35(1) requires the department of
9management (DOM) to deduct the amounts calculated for special
10education support services, media services, area education
11agency teacher salary supplement district cost, area education
12agency professional development supplement district cost, and
13educational services for each school district from the state
14aid due to the district pursuant to Code chapter 257 and pay
15the amounts to the respective area education agencies on a
16monthly basis from September 15 through June 15 during each
17school year. The bill modifies this provision to instead
18require the amounts to be paid on a monthly basis as determined
19by the DOM in the same manner as provided under Code section
20257.16(2) as amended by the bill.
   21Current Code section 282.31(1)(a), related to children who
22live in certain specified facilities, requires the department
23of administrative services (DAS) to pay the approved budget
24amount for an area education agency in monthly installments
25beginning September 15 and ending June 15 of the next
26succeeding school year. The bill modifies this provision to
27instead require the DAS to pay the approved budget amount as
28determined by the DOM in the same manner as provided under Code
29section 257.16(2) as amended by the bill.
   30Current Code section 282.33(1), related to children under

10 Under current law, the special education support services
11district cost per pupil is the special education support
12services district cost per pupil for the base year plus the
13special education support services supplemental state aid
14for the budget year. The bill provides that, for the budget
15year beginning July 1, 2023, and succeeding budget years, for
16area education agencies that have fewer than 10 public school
17pupils per square mile, the special education support services
18district cost per pupil for the budget year is the special
19education support services district cost per pupil for the base
20year plus the special education support services supplemental
21state aid for the budget year plus 3 percent of the special
22education support services state cost per pupil for the budget
23year.
   24The bill provides that for budget years beginning on or after
25July 1, 2023, the state media services cost per pupil for each
26budget year is equal to the state media services cost per pupil
27for the base year plus the supplemental state aid for media
28services for the budget year. The bill also provides that for
29the budget year beginning July 1, 2023, and each succeeding
30budget year, the area media services cost per pupil is equal to
31the area media services cost per pupil for the base year plus
32the supplemental state aid for media services for the budget
33year plus, for area education agencies that have fewer than 10
34public school pupils per square mile, 3 percent of the state
35media services cost per pupil for the budget year.

   1The bill provides that for budget years beginning on or after

4cost per pupil for the base year plus the supplemental state
5aid for educational services for the budget year. The bill
6also provides that for the budget year beginning July 1, 2023,
7and each succeeding budget year, the area educational services

9per pupil for the base year plus the supplemental state aid
10for educational services for the budget year plus, for area
11education agencies that have fewer than 10 public school pupils
12per square mile, 3 percent of the state educational services
13cost per pupil for the budget year.
   14The bill makes conforming changes.
   15DIVISION III — PROFESSIONAL DEVELOPMENT EXPENSES. The bill
16requires each area education agency and each school district
17to include in the basic educational data survey information
18related to the training and professional development courses
19and programs provided by the area education agency or school
20district, as applicable, during the current school year. The
21bill also requires this information to include the total number
22of hours of required and optional training and professional
23development courses and programs, as well as the cost of the
24training and professional development courses and programs.
   25DIVISION IV — LEGISLATIVE INTERIM STUDY COMMITTEE —
26PRACTITIONER PREPARATION PROGRAMS. The bill requests that the
27legislative council establish an interim study committee during
28the 2022 interim and the 2023 interim to assess practitioner
29preparation programs. The bill requires the interim study
30committee to submit to the general assembly an initial report
31by December 15, 2022, and a final report by December 15, 2023.
