4relating to labor and employment, and providing penalties.
5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  16.37  Compliance with labor and
2employment laws in housing programs — withholding or rescission
3of funds — fees.
   41.  Any contractor or subcontractor performing work pursuant
5to a housing program shall comply with all applicable federal
6and state laws relating to labor and employment.
   72.  The authority may withhold or rescind funding provided
8pursuant to a housing program from any entity that does
9not comply with subsection 1 or rules adopted to administer
10subsection 1.
   113.  The authority shall require, as a condition of
12participation in a housing program by a county, city, or other
13political subdivision, or a private or nonprofit entity, that
14the political subdivision or entity ensure compliance with
15subsection 1 by any contractor or subcontractor retained by the
16political subdivision or entity to perform work pursuant to the
17housing program and facilitate implementation of subsection 2.
   184.  The authority may establish any fees necessary to cover
19the cost of ensuring compliance with this section for a housing
20program, which shall be adopted by rule pursuant to chapter
2117A. Any amount of fees collected by the authority under this
22subsection shall be considered repayment receipts as defined
23in section 8.2.
   245.  The authority shall reimburse a political subdivision
25for any documented costs associated with compliance with this
26section. Such reimbursement shall be considered a cost of
27compliance with this section for purposes of subsection 4.
   286.  The authority shall adopt rules pursuant to chapter 17A
29to administer this section.
30EXPLANATION
31The inclusion of this explanation does not constitute agreement with
32the explanation’s substance by the members of the general assembly.
   33This bill requires that any contractor or subcontractor
34performing work pursuant to a housing program administered by
35the Iowa finance authority comply with all applicable federal

   2The bill authorizes the authority to withhold or rescind
3funding provided pursuant to a housing program from any entity
4that does not comply with the bill.
   5The bill directs the authority to require, as a condition
6of participation in a housing program by a county, city, or
7other political subdivision, or a private or nonprofit entity,
8that the political subdivision or entity ensure compliance with
9the bill by any contractor or subcontractor retained by the
10political subdivision or entity to perform work pursuant to the
11housing program.
   12The bill authorizes the authority to establish by rule any
13fees necessary to cover the cost of ensuring compliance with
14the bill for a housing program.
   15The bill requires the authority to reimburse a political
16subdivision for any documented costs associated with compliance
17with the bill.
