3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  PARA-EDUCATORS HOLDING SUBSTITUTE AUTHORIZATIONS
2— 2021-2022 SCHOOL YEAR.
   31.  For the school year beginning July 1, 2021, a
4para-educator certified under section 272.12 with a substitute
5authorization may substitute in any classroom in grades
6pre-kindergarten through twelve, except a driver’s education
7classroom.
   82.  A school district shall make a good-faith effort to
9employ a substitute teacher who is not a para-educator before
10employing a para-educator for a position pursuant to subsection
111. A school district employing a para-educator as a substitute
12pursuant to subsection 1 shall compensate the person at the
13same rate as would be provided to a substitute teacher who is
14not a para-educator for the same work.
   153.  The board of educational examiners may adopt emergency
16rules under section 17A.4, subsection 3, and section 17A.5,
17subsection 2, paragraph “b”, to implement the provisions of
18this section and the rules shall be effective immediately upon
19filing unless a later date is specified in the rules. Any
20rules adopted in accordance with this section shall also be
21published as a notice of intended action as provided in section
2217A.4.
23   Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of immediate
24importance, takes effect upon enactment.
25EXPLANATION
26The inclusion of this explanation does not constitute agreement with
27the explanation’s substance by the members of the general assembly.
   28This bill provides that for the school year beginning July 1,
292021, a certified para-educator with a substitute authorization
30may substitute in any classroom in grades pre-kindergarten
31through 12, except a driver’s education classroom.
   32The bill requires a school district to make a good-faith
33effort to employ a substitute teacher who is not a
34para-educator before employing a para-educator for a position
35pursuant to the bill. The bill requires a school district
-1-1employing a para-educator as a substitute pursuant to the bill
2to compensate the person at the same rate as would be provided
3to a substitute teacher who is not a para-educator for the same
4work.
   5The bill authorizes the board of educational examiners to
6adopt emergency rules to implement the bill. The bill takes
7effect upon enactment.
