2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  70A.21  Donated leave for state
2employees.
   31.  For purposes of this section:
   4a.  “Donated leave” means vacation and sick leave hours
5donated to an eligible recipient.
   6b.  “Eligible recipient” means an eligible state employee.
   7c.  “Eligible state employee” means a full-time or part-time
8state employee who is eligible to accrue vacation.
   92.  Eligible state employees are allowed to donate leave
10hours to an eligible recipient. Contributions shall be
11designated as donated leave and shall be subject to the
12requirements of this section.
   133.  An eligible state employee shall be allowed to donate
14leave to an eligible recipient subject to the following
15requirements:
   16a.  Vacation and sick leave hours shall be donated in
17whole-hour increments; however, vacation and sick leave
18hours may be credited to the eligible recipient in other than
19whole-hour increments. Donated vacation hours shall not
20exceed the maximum allowable vacation hours for the eligible
21recipient.
   22b.  Donated leave hours will be credited in increments not to
23exceed the eligible employee’s regularly scheduled work hours
24on a pay-period-by-pay-period basis.
   25c.  Approval of use of donated leave shall be for a period
26not to exceed one year either on an intermittent or continuous
27basis for each occurrence.
   28d.  Donated leave shall be irrevocable after it is credited
29to the eligible recipient. Donated leave hours not credited to
30the eligible recipient will not be deducted from the donor’s
31vacation or sick leave balance.
32EXPLANATION
33The inclusion of this explanation does not constitute agreement with
34the explanation’s substance by the members of the general assembly.
   35This bill allows a full-time or part-time state employee
-1-1who is eligible to accrue vacation to donate vacation and sick
2leave hours to an eligible recipient, defined as a full-time or
3part-time state employee eligible to accrue vacation.
   4The bill allows vacation and sick leave hours to be donated
5to an eligible recipient. The bill provides that donated
6vacation hours shall not exceed the maximum allowable vacation
7hours for the eligible recipient. The bill provides that
8approval of use of donated leave shall be for a period not
9to exceed one year and that donated vacation and sick leave
10hours shall be irrevocable after it is credited to the eligible
11recipient.
