3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 392.5, Code 2022, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  4.  When residents of a city served by a
4library board express concern about a specific book or other
5material, the council may, by majority vote, overturn a library
6board’s decision to place the book or other material in a
7particular location within the library. If the council votes
8to overturn the library board’s decision, the council shall
9provide direction to the library board for placement of the
10book or other material, which may include placing the book or
11other material in a secure location and limiting check-out
12privileges for the book or other material to adults if the book
13or other material is considered sensitive in nature.
14EXPLANATION
15The inclusion of this explanation does not constitute agreement with
16the explanation’s substance by the members of the general assembly.
   17This bill relates to the placement of books and other
18materials in city libraries. The bill provides that when
19residents of a city served by a library board express concern
20about a specific book or other material, the city council may,
21by majority vote, overturn a library board’s decision to place
22the book or other material in a particular location within a
23library. If the council votes to overturn the library board’s
24decision, the council shall provide direction to the library
25board for placement of the book or other material, which may
26include placing the book or other material in a secure location
27and limiting check-out privileges for the book or other
28material to adults if the book or other material is considered
29sensitive in nature.
