3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  602.1601A  Video and telephonic
2hearings in judicial proceedings.
   31.  Upon motion of any of the parties, an arraignment,
4pretrial conference, scheduling conference, or any other
5noncontested judicial proceeding shall be conducted by
6videoconference or telephone with the parties and other
7participants.
   82.  Upon motion of any of the parties, a hearing in a
9judicial proceeding may be conducted by videoconference or
10telephone with the parties and other participants if the
11hearing is conducted in an efficient manner and the hearing
12does not prejudice a substantial right of either party.
13EXPLANATION
14The inclusion of this explanation does not constitute agreement with
15the explanation’s substance by the members of the general assembly.
   16This bill relates to video and telephonic hearings in
17judicial proceedings.
   18The bill provides that upon motion of any party, an
19arraignment, pretrial conference, scheduling conference, or
20any other noncontested judicial proceeding shall be conducted
21by videoconference or telephone with the parties and other
22participants. Upon motion of any party, a hearing in a
23judicial proceeding may be conducted with the parties and other
24participants by videoconference or telephone when the hearing
25can be handled efficiently and a substantial right of a party
26is not prejudiced.
