3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  236.21  Domestic abuse relief
2inquiries — driver’s license and nonoperator identification
3card.
   41.  The department shall create and issue domestic abuse
5relief inquiry documents to allow a victim of domestic abuse
6to obtain a driver’s license or nonoperator’s identification
7card. The document shall contain the victim’s full legal name
8and date of birth and be notarized.
   92.  The department may authorize a provider of emergency
10shelter services and support services to victims of domestic
11abuse to issue domestic abuse relief inquiry documents created
12pursuant to subsection 1.
   133.  The department shall adopt rules pursuant to chapter 17A
14to implement this section.
15   Sec. 2.  Section 321.182, subsections 2 and 3, Code 2022, are
16amended to read as follows:
   172.  Surrender all other driver’s licenses and nonoperator’s
18identification cards. This subsection shall not apply to a
19person who is applying for a license using a properly completed
20document created pursuant to section 236.21.

   213.  a.  Certify that the applicant has no other driver’s
22license and certify that the applicant is a resident of this
23state as provided in section 321.1A. However, certification
   24b.   Certificationof residency is not required for an
25applicant for a nonresident commercial driver’s license or
26nonresident commercial learner’s permit. Certification that
27the applicant has no other driver’s license is not required
28for a person who is applying for a license using a properly
29completed document created pursuant to section 236.21.

30   Sec. 3.  Section 321.190, subsection 1, paragraph b,
31subparagraph (1), Code 2022, is amended to read as follows:
   32(1)  The department shall not issue a card to a person
33holding a driver’s license unless the person is applying for
34a card using a properly completed document created pursuant
35to section 236.21
. However, a card may be issued to a person
-1-1holding a temporary permit under section 321.181. The card
2shall be identical in form to a driver’s license issued under
3section 321.189 except the word “nonoperator” shall appear
4prominently on the face of the card.
5   Sec. 4.  DEPARTMENT OF TRANSPORTATION — DOMESTIC ABUSE
6VICTIM IDENTIFICATION CARDS.
  The department of transportation
7shall, in collaboration with the department of justice, amend
8its administrative rules pursuant to chapter 17A to provide
9that a victim of domestic abuse who submits a notarized
10domestic abuse relief inquiry document to the department
11of transportation shall satisfy the requirements to obtain
12a nonoperator’s identification card and identification
13requirements to obtain a driver’s license.
14EXPLANATION
15The inclusion of this explanation does not constitute agreement with
16the explanation’s substance by the members of the general assembly.
   17This bill relates to driver’s licenses and nonoperator
18identification cards for victims of domestic abuse.
   19The bill requires the department of justice to adopt rules
20to create and issue a domestic abuse relief inquiry document
21to allow a victim of domestic abuse to obtain a nonoperator’s
22identification card. The document shall contain the victim’s
23full legal name and date of birth and be notarized.
   24The bill allows the department of justice to authorize a
25provider of emergency shelter services and support services
26to victims of domestic abuse to issue domestic abuse relief
27inquiry documents.
   28The bill allows a person to apply for a driver’s license
29without surrendering all other driver’s licenses and
30nonoperator’s licenses or certifying the person has no other
31driver’s license if the person is applying for a driver’s
32license using a properly completed domestic relief inquiry
33document.
   34The bill allows a person to obtain a nonoperator’s
35identification card if the person is applying for a card using
-2-1a properly completed domestic abuse relief inquiry document.
   2The bill directs the department of transportation, in
3collaboration with the department of justice, to amend its
4administrative rules to provide that a victim of domestic
5abuse who submits a notarized domestic abuse relief inquiry
6document to the department of transportation shall satisfy the
7requirements to obtain a nonoperator’s identification card and
8identification requirements to obtain a driver’s license.
