Senate Study Bill 3087 - IntroducedA Bill ForAn Act 1providing for the removal of municipal utility board

4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 388.3, subsection 1, Code 2022, is
2amended to read as follows:
   31.  If a proposal to establish a utility board receives
4a favorable majority vote, the mayor shall appoint the board
5members, as provided in the proposal, subject to the approval
6of the council. The council shall by resolution provide for
7staggered six-year terms for, and shall set the compensation
8of, board members. Notwithstanding section 372.15, utility
9board members are subject to removal only pursuant to section
1066.1A.

11   Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of immediate
12importance, takes effect upon enactment.
13EXPLANATION
14The inclusion of this explanation does not constitute agreement with
15the explanation’s substance by the members of the general assembly.
   16This bill relates to utility board member removal criteria.
   17The bill provides that utility board members shall be
18subject to removal only as provided in Code section 66.1A.
19That section provides that an appointive or elective officer
20may be removed from office by the district court for willful
21or habitual neglect or refusal to perform the duties of the
22office, willful misconduct or maladministration in office,
23corruption, extortion, conviction of a felony, intoxication or
24conviction for intoxication, campaign finance violations, and
25failure to pay specified fines.
   26The bill takes effect upon enactment.
