3legislative services agency.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 42.3, subsections 2 and 3, Code 2022, are
2amended to read as follows:
   32.  If the bill embodying the plan submitted by the
4legislative services agency under subsection 1 fails to be
5enacted, the legislative services agency shall prepare a bill
6embodying a second plan of legislative and congressional
7districting. The bill shall be prepared in accordance with
8section 42.4, and, insofar as it is possible to do so within
9the requirements of section 42.4, with the reasons cited by
10the senate or house of representatives by resolution, or the
11governor by veto message, for the failure to approve the plan.
12If a second plan is required under this subsection, the bill
13embodying it shall be delivered to the secretary of the senate
14and the chief clerk of the house of representatives not later
15than thirty-five twenty-one days after the date of the vote
16by which the senate or the house of representatives fails to
17approve the bill submitted under subsection 1, or the date
18the governor vetoes or fails to approve the bill. If it is
19necessary to submit a bill under this subsection, the bill
20shall be brought to a vote not less than seven days after the
21bill is submitted and made available to the members of the
22general assembly, under a procedure or rule permitting no
23amendments except those of a purely corrective nature. It
24is further the intent of this chapter that if the bill is
25approved by the first house in which it is considered, it
26shall expeditiously be brought to a vote in the second house
27under a similar procedure or rule. If the bill embodying the
28plan submitted by the legislative services agency under this
29subsection fails to be approved by a constitutional majority
30in either the senate or the house of representatives, the
31secretary of the senate or the chief clerk of the house, as the
32case may be, shall transmit to the legislative services agency
33in the same manner as described in subsection 1, information
34which the senate or house may direct by resolution regarding
35reasons why the plan was not approved.

   13.  If the bill embodying the plan submitted by the
2legislative services agency under subsection 2 fails to be
3enacted, the same procedure as prescribed by subsection 2
4shall be followed. If a third plan is required under this
5subsection, the bill embodying it shall be delivered to the
6secretary of the senate and the chief clerk of the house of
7representatives not later than thirty-five twenty-one days
8after the date of the vote by which the senate or the house
9of representatives fails to approve the bill submitted under
10subsection 2, or the date the governor vetoes or fails to
11approve the bill. The legislative services agency shall
12submit a bill under this subsection sufficiently in advance of
13September 1 of the year ending in one to permit the general
14assembly to consider the plan prior to that date. If it is
15necessary to submit a bill under this subsection, the bill
16shall be brought to a vote within the same time period after
17its delivery to the secretary of the senate and the chief clerk
18of the house of representatives as is prescribed for the bill
19submitted under subsection 2, but shall be subject to amendment
20in the same manner as other bills.
21EXPLANATION
22The inclusion of this explanation does not constitute agreement with
23the explanation’s substance by the members of the general assembly.
   24This bill concerns the timetable for preparing a second or
25third plan of legislative and congressional redistricting by
26the legislative services agency following rejection of the
27prior plan. The bill provides that a bill embodying a second
28or third plan of legislative and congressional redistricting
29shall be submitted to the general assembly no less than 21
30days, instead of the current 35 days, after the previous plan
31of legislative and congressional redistricting fails to be
32approved.
