3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2fy 2021–2022
3   Section 1.  DEPARTMENT OF JUSTICE.
   41.  There is appropriated from the general fund of the state
5to the department of justice for the fiscal year beginning July
61, 2021, and ending June 30, 2022, the following amounts, or
7so much thereof as is necessary, to be used for the purposes
8designated:
   9a.  For the general office of attorney general for
10salaries, support, maintenance, and miscellaneous purposes,
11including the prosecuting attorneys training program, matching
12funds for federal violence against women grant programs,
13victim assistance grants, the office of drug control policy
14prosecuting attorney program, and odometer fraud enforcement:

   16As a condition of receiving the appropriation provided
17in this lettered paragraph, the department of justice shall
18maintain a record of the estimated time incurred representing
19each agency or department.
   20The general office of attorney general may temporarily
21exceed and draw more than the amount appropriated in this
22lettered paragraph and incur a negative cash balance as long
23as there are receivables equal to or greater than the negative
24balances and the amount appropriated in this lettered paragraph
25is not exceeded at the close of the fiscal year.
   26b.  For victim assistance grants:

   28The moneys appropriated in this lettered paragraph shall be
29used to provide grants to care providers providing services to
30crime victims of domestic abuse or to crime victims of rape and
31sexual assault.
   32The balance of the victim compensation fund established
33in section 915.94 may be used to provide salary and support
34of not more than 24.00 full-time equivalent positions and to
35provide maintenance for the victim compensation functions
-1-1of the department of justice. In addition to the full-time
2equivalent positions authorized pursuant to this paragraph,
35.00 full-time equivalent positions are authorized and shall
4be used by the department of justice to employ one accountant
5and four program planners. The department of justice may
6employ the additional 5.00 full-time equivalent positions
7authorized pursuant to this paragraph that are in excess of the
8number of full-time equivalent positions authorized only if
9the department of justice receives sufficient federal moneys
10to maintain employment for the additional full-time equivalent
11positions during the current fiscal year. The department
12of justice shall only employ the additional 5.00 full-time
13equivalent positions in succeeding fiscal years if sufficient
14federal moneys are received during each succeeding fiscal year.
   15The department of justice shall transfer at least $150,000
16from the victim compensation fund established in section 915.94
17to the victim assistance grant program established in section
1813.31.
   19Notwithstanding section 8.33, moneys appropriated in this
20lettered paragraph that remain unencumbered or unobligated at
21the close of the fiscal year shall not revert but shall remain
22available for expenditure for the purposes designated until the
23close of the succeeding fiscal year.
   24c.  For legal services for persons in poverty grants as
25provided in section 13.34:

   272.  a.  The department of justice, in submitting budget
28estimates for the fiscal year beginning July 1, 2022, pursuant
29to section 8.23, shall include a report of funding from sources
30other than amounts appropriated directly from the general fund
31of the state to the department of justice or to the office of
32consumer advocate. These funding sources shall include but
33are not limited to reimbursements from other state agencies,
34commissions, boards, or similar entities, and reimbursements
35from special funds or internal accounts within the department
-2-1of justice. The department of justice shall also report actual
2reimbursements for the fiscal year beginning July 1, 2020,
3and actual and expected reimbursements for the fiscal year
4beginning July 1, 2021.
   5b.  The department of justice shall include the report
6required under paragraph “a”, as well as information regarding
7any revisions occurring as a result of reimbursements actually
8received or expected at a later date, in a report to the
9co-chairpersons and ranking members of the joint appropriations
10subcommittee on the justice system and the legislative services
11agency. The department of justice shall submit the report on
12or before January 15, 2022.
   133.  a.  The department of justice shall fully reimburse
14the costs and necessary related expenses incurred by the Iowa
15law enforcement academy to continue to employ one additional
16instructor position who shall provide training for human
17trafficking-related issues throughout the state.
   18b.  The department of justice shall obtain the moneys
19necessary to reimburse the Iowa law enforcement academy to
20employ such an instructor from unrestricted moneys from either
21the victim compensation fund established in section 915.94, the
22human trafficking victim fund established in section 915.95, or
23the human trafficking enforcement fund established in 2015 Iowa
24Acts, chapter 138, section 141.
   254.  REPORT OF MONEY AWARDS.  The attorney general shall
26submit a report to the general assembly and the department of
27management all money settlement awards and court money awards
28which were awarded to the state of Iowa. The attorney general
29shall report which funds are designated to receive the moneys
30and under what legal authority the designation is being made.
31Reports must be submitted within 30 days following a money
32settlement award or a court money award.
33   Sec. 2.  OFFICE OF CONSUMER ADVOCATE.  There is appropriated
34from the department of commerce revolving fund created in
35section 546.12 to the office of consumer advocate of the
-3-1department of justice for the fiscal year beginning July 1,
22021, and ending June 30, 2022, the following amount, or so
3much thereof as is necessary, to be used for the purposes
4designated:

   272.  The department of corrections shall use moneys
28appropriated in subsection 1 to continue to contract for the
29services of a Muslim imam and a Native American spiritual
30leader.
31   Sec. 4.  DEPARTMENT OF CORRECTIONS — ADMINISTRATION.
   32There is appropriated from the general fund of the state to the
33department of corrections for the fiscal year beginning July
341, 2021, and ending June 30, 2022, the following amounts, or
35so much thereof as is necessary, to be used for the purposes

   21.  For general administration, including salaries and the
3adjustment of salaries throughout the department, support,
4maintenance, employment of an education director to administer
5a centralized education program for the correctional system,
6and miscellaneous purposes:

   8a.  It is the intent of the general assembly that each
9lease negotiated by the department of corrections with a
10private corporation for the purpose of providing private
11industry employment of inmates in a correctional institution
12shall prohibit the private corporation from utilizing inmate
13labor for partisan political purposes for any person seeking
14election to public office in this state and that a violation
15of this requirement shall result in a termination of the lease
16agreement.
   17b.  It is the intent of the general assembly that as a
18condition of receiving the appropriation provided in this
19subsection the department of corrections shall not enter into
20a lease or contractual agreement pursuant to section 904.809
21with a private corporation for the use of building space for
22the purpose of providing inmate employment without providing
23that the terms of the lease or contract establish safeguards to
24restrict, to the greatest extent feasible, access by inmates
25working for the private corporation to personal identifying
26information of citizens.
   272.  For educational programs for inmates at state penal
28institutions:

   30a.  To maximize the funding for educational programs,
31the department shall establish guidelines and procedures to
32prioritize the availability of educational and vocational
33training for inmates based upon the goal of facilitating an
34inmate’s successful release from the correctional institution.
   35b.  The director of the department of corrections may
-6-1transfer moneys from Iowa prison industries and the canteen
2operating funds established pursuant to section 904.310, for
3use in educational programs for inmates.
   4c.  Notwithstanding section 8.33, moneys appropriated in
5this subsection that remain unencumbered or unobligated at the
6close of the fiscal year shall not revert but shall remain
7available to be used only for the purposes designated in this
8subsection until the close of the succeeding fiscal year.
   93.  For the development and operation of the Iowa corrections
10offender network (ICON) data system:

21to the department of corrections for the fiscal year beginning
22July 1, 2021, and ending June 30, 2022, for salaries, support,
23maintenance, and miscellaneous purposes, the following amounts,
24or so much thereof as is necessary, to be used for the purposes
25designated:
   26a.  For the first judicial district department of
27correctional services:

33July 1, 2021, and ending June 30, 2022, the following amount,
34or so much thereof as is necessary, to be used for the purposes

1For statewide judicial assistance, support, and pilot
2projects for judicial district departments of correctional
3services:

   53.  Each judicial district department of correctional
6services, within the moneys available, shall continue programs
7and plans established within that district to provide for
8intensive supervision, sex offender treatment, diversion of
9low-risk offenders to the least restrictive sanction available,
10job development, and expanded use of intermediate criminal
11sanctions.
   124.  Each judicial district department of correctional
13services shall provide alternatives to prison consistent with
14chapter 901B. The alternatives to prison shall ensure public
15safety while providing maximum rehabilitation to the offender.
16A judicial district department of correctional services may
17also establish a day program.
   185.  The governor’s office of drug control policy shall
19consider federal grants made to the department of corrections
20for the benefit of each of the eight judicial district
21departments of correctional services as local government
22grants, as defined pursuant to federal regulations.
   236.  The department of corrections shall continue to contract
24with a judicial district department of correctional services to
25provide for the rental of electronic monitoring equipment which
26shall be available statewide.
   277.  The public safety assessment shall not be utilized
28in pretrial hearings when determining whether to detain or
29release a defendant before trial, and the use of the public
30safety assessment pilot program shall be terminated as of the
31effective date of this subsection, until such time the use of
32the public safety assessment has been specifically authorized
33by the general assembly.
34   Sec. 6.  DEPARTMENT OF CORRECTIONS — REALLOCATION OF
35APPROPRIATIONS.
  Notwithstanding section 8.39, within the
-9-1moneys appropriated in this division of this Act to the
2department of corrections, the department may reallocate the
3moneys appropriated and allocated as necessary to best fulfill
4the needs of the correctional institutions, administration
5of the department, and the judicial district departments of
6correctional services. However, in addition to complying with
7the requirements of sections 904.116 and 905.8 and providing
8notice to the legislative services agency, the department
9of corrections shall also provide notice to the department
10of management, prior to the effective date of the revision
11or reallocation of an appropriation made pursuant to this
12section. The department of corrections shall not reallocate an
13appropriation or allocation for the purpose of eliminating any
14program.
15   Sec. 7.  INTENT — REPORTS.
   161.  The department of corrections, in cooperation with
17townships, the Iowa cemetery associations, and other nonprofit
18or governmental entities, may use inmate labor during the
19fiscal year beginning July 1, 2021, to restore or preserve
20rural cemeteries and historical landmarks. The department, in
21cooperation with the counties, may also use inmate labor to
22clean up roads, major water sources, and other water sources
23around the state.
   242.  On a quarterly basis, the department shall provide
25a status report regarding private-sector employment to the
26legislative services agency beginning on July 1, 2021. The
27report shall include the number of offenders employed in the
28private sector, the combined number of hours worked by the
29offenders, the total amount of allowances, and the distribution
30of allowances pursuant to section 904.702, including any moneys
31deposited in the general fund of the state.
32   Sec. 8.  ELECTRONIC MONITORING REPORT.  The department of
33corrections shall submit a report on electronic monitoring to
34the general assembly, to the co-chairpersons and the ranking
35members of the joint appropriations subcommittee on the justice
-10-1system, and to the legislative services agency by January
215, 2022. The report shall specifically address the number
3of persons being electronically monitored and break down the
4number of persons being electronically monitored by offense
5committed. The report shall also include a comparison of any
6data from the prior fiscal year with the current fiscal year.
7   Sec. 9.  STATE AGENCY PURCHASES FROM PRISON INDUSTRIES.
   81.  As used in this section, unless the context otherwise
9requires, “state agency” means the government of the state
10of Iowa, including but not limited to all executive branch
11departments, agencies, boards, bureaus, and commissions, the
12judicial branch, the general assembly and all legislative
13agencies, institutions within the purview of the state board of
14regents, and any corporation whose primary function is to act
15as an instrumentality of the state.
   162.  State agencies are encouraged to purchase products from
17Iowa state industries, as defined in section 904.802, when
18purchases are required and the products are available from
19Iowa state industries. State agencies shall obtain bids from
20Iowa state industries for purchases of office furniture during
21the fiscal year beginning July 1, 2021, exceeding $5,000 or
22in accordance with applicable administrative rules related to
23purchases for the agency.
24   Sec. 10.  IOWA LAW ENFORCEMENT ACADEMY.
   251.  There is appropriated from the general fund of the
26state to the Iowa law enforcement academy for the fiscal year
27beginning July 1, 2021, and ending June 30, 2022, the following
28amount, or so much thereof as is necessary, to be used for the
29purposes designated:
   30a.  For salaries, support, maintenance, and miscellaneous
31purposes, including jailer training and technical assistance:

   33b.  The Iowa law enforcement academy may temporarily exceed
34and draw more than the amount appropriated in this subsection
35and incur a negative cash balance as long as there are

2the amount appropriated in this subsection is not exceeded at
3the close of the fiscal year.
   42.  The Iowa law enforcement academy may select at least
5five automobiles of the department of public safety, division
6of state patrol, prior to turning over the automobiles to
7the department of administrative services to be disposed
8of by public auction, and the Iowa law enforcement academy
9may exchange any automobile owned by the academy for each
10automobile selected if the selected automobile is used in
11training law enforcement officers at the academy. However, any
12automobile exchanged by the academy shall be substituted for
13the selected vehicle of the department of public safety and
14sold by public auction with the receipts being deposited in the
15depreciation fund maintained pursuant to section 8A.365 to the
16credit of the department of public safety, division of state
17patrol.
   183.  The Iowa law enforcement academy shall provide training
19for domestic abuse and human trafficking-related issues
20throughout the state. The training shall be offered at no
21cost to the attendees and the training shall not replace any
22existing domestic abuse or human trafficking training offered
23by the academy.
24   Sec. 11.  STATE PUBLIC DEFENDER.  There is appropriated from
25the general fund of the state to the office of the state public
26defender of the department of inspections and appeals for the
27fiscal year beginning July 1, 2021, and ending June 30, 2022,
28the following amounts, or so much thereof as is necessary, to
29be used for the purposes designated:
   301.  For salaries, support, maintenance, and miscellaneous
31purposes:

25   Sec. 14.  DEPARTMENT OF HOMELAND SECURITY AND EMERGENCY

   271.  There is appropriated from the general fund of the state
28to the department of homeland security and emergency management
29for the fiscal year beginning July 1, 2021, and ending June 30,
302022, the following amount, or so much thereof as is necessary,
31to be used for the purposes designated:

   352.  The department of homeland security and emergency

7   Sec. 15.  DEPARTMENT OF PUBLIC SAFETY.  There is appropriated
8from the general fund of the state to the department of public
9safety for the fiscal year beginning July 1, 2021, and ending
10June 30, 2022, the following amounts, or so much thereof as is
11necessary, to be used for the purposes designated:
   121.  For administrative functions, including salaries and
13the adjustment of salaries throughout the department, and the
14criminal justice information system:

   20Notwithstanding section 8.39, the department of public
21safety may reallocate moneys appropriated in this section
22as necessary to best fulfill the needs provided for in the
23appropriation. However, the department shall not reallocate
24moneys appropriated to the department in this section unless
25notice of the reallocation is given to the legislative services
26agency and the department of management prior to the effective
27date of the reallocation. The notice shall include information
28regarding the rationale for reallocating the moneys. The
29department shall not reallocate moneys appropriated in this
30section for the purpose of eliminating any program.
31   Sec. 16.  GAMING ENFORCEMENT.
   321.  There is appropriated from the gaming enforcement
33revolving fund created in section 80.43 to the department of
34public safety for the fiscal year beginning July 1, 2021, and
35ending June 30, 2022, the following amount, or so much thereof
-16-1as is necessary, to be used for the purposes designated:
   2For any direct support costs for agents and officers of
3the division of criminal investigation’s excursion gambling
4boat, gambling structure, and racetrack enclosure enforcement
5activities, including salaries, support, maintenance, and
6miscellaneous purposes:

   82.  For each additional license to conduct gambling games on
9an excursion gambling boat, gambling structure, or racetrack
10enclosure issued during the fiscal year beginning July 1, 2021,
11there is appropriated from the gaming enforcement fund to the
12department of public safety for the fiscal year beginning
13July 1, 2021, and ending June 30, 2022, an additional amount
14of not more than $300,000 to be used for salaries, support,

8provide maintenance for the victim compensation functions

115.00 full-time equivalent positions are authorized and shall

13and four program planners. The department of justice may
14employ the additional 5.00 full-time equivalent positions

   213.  a.  The department of justice shall fully reimburse
22the costs and necessary related expenses incurred by the Iowa
23law enforcement academy to continue to employ one additional
24instructor position who shall provide training for human
25trafficking-related issues throughout the state.
   26b.  The department of justice shall obtain the moneys
27necessary to reimburse the Iowa law enforcement academy to
28employ such an instructor from unrestricted moneys from either
29the victim compensation fund established in section 915.94, the
30human trafficking victim fund established in section 915.95, or
31the human trafficking enforcement fund established in 2015 Iowa
32Acts, chapter 138, section 141.
   334.  REPORT OF MONEY AWARDS.  The attorney general shall
34submit a report to the general assembly and the department of
35management all money settlement awards and court money awards

2shall report which funds are designated to receive the moneys
3and under what legal authority the designation is being made.

23of this requirement shall result in a termination of the lease
24agreement.
   25b.  It is the intent of the general assembly that as a
26condition of receiving the appropriation provided in this
27subsection the department of corrections shall not enter into
28a lease or contractual agreement pursuant to section 904.809
29with a private corporation for the use of building space for
30the purpose of providing inmate employment without providing
31that the terms of the lease or contract establish safeguards to
32restrict, to the greatest extent feasible, access by inmates
33working for the private corporation to personal identifying
34information of citizens.
   352.  For educational programs for inmates at state penal

   204.  Each judicial district department of correctional
21services shall provide alternatives to prison consistent with
22chapter 901B. The alternatives to prison shall ensure public
23safety while providing maximum rehabilitation to the offender.
24A judicial district department of correctional services may
25also establish a day program.
   265.  The governor’s office of drug control policy shall
27consider federal grants made to the department of corrections
28for the benefit of each of the eight judicial district
29departments of correctional services as local government
30grants, as defined pursuant to federal regulations.
   316.  The department of corrections shall continue to contract
32with a judicial district department of correctional services to
33provide for the rental of electronic monitoring equipment which
34shall be available statewide.
   357.  The public safety assessment shall not be utilized
-27-1in pretrial hearings when determining whether to detain or
2release a defendant before trial, and the use of the public
3safety assessment pilot program shall be terminated as of the
4effective date of this subsection, until such time the use of
5the public safety assessment has been specifically authorized
6by the general assembly.
7   Sec. 26.  DEPARTMENT OF CORRECTIONS — REALLOCATION OF
8APPROPRIATIONS.
  Notwithstanding section 8.39, within the
9moneys appropriated in this division of this Act to the
10department of corrections, the department may reallocate the
11moneys appropriated and allocated as necessary to best fulfill
12the needs of the correctional institutions, administration
13of the department, and the judicial district departments of
14correctional services. However, in addition to complying with
15the requirements of sections 904.116 and 905.8 and providing
16notice to the legislative services agency, the department
17of corrections shall also provide notice to the department
18of management, prior to the effective date of the revision
19or reallocation of an appropriation made pursuant to this
20section. The department of corrections shall not reallocate an
21appropriation or allocation for the purpose of eliminating any
22program.
23   Sec. 27.  INTENT — REPORTS.
   241.  The department of corrections, in cooperation with
25townships, the Iowa cemetery associations, and other nonprofit
26or governmental entities, may use inmate labor during the
27fiscal year beginning July 1, 2022, to restore or preserve
28rural cemeteries and historical landmarks. The department, in
29cooperation with the counties, may also use inmate labor to
30clean up roads, major water sources, and other water sources
31around the state.
   322.  On a quarterly basis, the department shall provide
33a status report regarding private-sector employment to the
34legislative services agency beginning on July 1, 2022. The
35report shall include the number of offenders employed in the
-28-1private sector, the combined number of hours worked by the
2offenders, the total amount of allowances, and the distribution
3of allowances pursuant to section 904.702, including any moneys
4deposited in the general fund of the state.
5   Sec. 28.  ELECTRONIC MONITORING REPORT.  The department of
6corrections shall submit a report on electronic monitoring to
7the general assembly, to the co-chairpersons and the ranking
8members of the joint appropriations subcommittee on the justice
9system, and to the legislative services agency by January
1015, 2023. The report shall specifically address the number
11of persons being electronically monitored and break down the
12number of persons being electronically monitored by offense
13committed. The report shall also include a comparison of any
14data from the prior fiscal year with the current fiscal year.
15   Sec. 29.  STATE AGENCY PURCHASES FROM PRISON INDUSTRIES.
   161.  As used in this section, unless the context otherwise
17requires, “state agency” means the government of the state
18of Iowa, including but not limited to all executive branch
19departments, agencies, boards, bureaus, and commissions, the
20judicial branch, the general assembly and all legislative
21agencies, institutions within the purview of the state board of
22regents, and any corporation whose primary function is to act
23as an instrumentality of the state.
   242.  State agencies are encouraged to purchase products from
25Iowa state industries, as defined in section 904.802, when
26purchases are required and the products are available from
27Iowa state industries. State agencies shall obtain bids from
28Iowa state industries for purchases of office furniture during
29the fiscal year beginning July 1, 2022, exceeding $5,000 or
30in accordance with applicable administrative rules related to
31purchases for the agency.
32   Sec. 30.  IOWA LAW ENFORCEMENT ACADEMY.
   331.  There is appropriated from the general fund of the
34state to the Iowa law enforcement academy for the fiscal year
35beginning July 1, 2022, and ending June 30, 2023, the following

16of by public auction, and the Iowa law enforcement academy
17may exchange any automobile owned by the academy for each
18automobile selected if the selected automobile is used in
19training law enforcement officers at the academy. However, any
20automobile exchanged by the academy shall be substituted for
21the selected vehicle of the department of public safety and
22sold by public auction with the receipts being deposited in the
23depreciation fund maintained pursuant to section 8A.365 to the
24credit of the department of public safety, division of state
25patrol.
   263.  The Iowa law enforcement academy shall provide training
27for domestic abuse and human trafficking-related issues
28throughout the state. The training shall be offered at no
29cost to the attendees and the training shall not replace any
30existing domestic abuse or human trafficking training offered
31by the academy.
32   Sec. 31.  STATE PUBLIC DEFENDER.  There is appropriated from
33the general fund of the state to the office of the state public
34defender of the department of inspections and appeals for the
35fiscal year beginning July 1, 2022, and ending June 30, 2023,

34agency and the department of management prior to the effective
35date of the reallocation. The notice shall include information

4   Sec. 36.  GAMING ENFORCEMENT.
   51.  There is appropriated from the gaming enforcement
6revolving fund created in section 80.43 to the department of
7public safety for the fiscal year beginning July 1, 2022, and
8ending June 30, 2023, the following amount, or so much thereof
9as is necessary, to be used for the purposes designated:
   10For any direct support costs for agents and officers of
11the division of criminal investigation’s excursion gambling
12boat, gambling structure, and racetrack enclosure enforcement
13activities, including salaries, support, maintenance, and
14miscellaneous purposes:

   162.  For each additional license to conduct gambling games on
17an excursion gambling boat, gambling structure, or racetrack

3to the criminal and juvenile justice planning division of the
4department of human rights for the fiscal year beginning July

17system.
   18DIVISION I — FY 2021–2022. The bill makes appropriations
19from the general fund of the state for FY 2021-2022 to the
20departments of justice, corrections, public defense, public
21safety, and homeland security and emergency management, and
22the Iowa law enforcement academy, office of the state public
23defender, board of parole, Iowa state civil rights commission,
24and the criminal and juvenile justice planning division of the
25department of human rights.
   26The bill appropriates moneys from the department of commerce
27revolving fund for FY 2021-2022 to the office of consumer
28advocate of the department of justice.
