3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 207.21, subsection 1, Code 2021, is
2amended to read as follows:
   31.  a.  The division shall participate in the abandoned
4mine reclamation program under Pub.L. No.95-87, Tit.IV,
5codified at 30 U.S.C. ch.25, subch.IV. There is established
6an abandoned mine reclamation fund under the control of the
7division.
   8b.  The division shall also provide for the reclamation or
9drainage abatement of lead mines as provided in this section
10which shall be supported by moneys appropriated by federal
11sources, if available.
12   Sec. 2.  Section 207.21, subsection 2, paragraph a,
13subparagraph (1), Code 2021, is amended to read as follows:
   14(1)  Lands which were mined for coal or lead or affected by
15such mining, waste banks, coal or lead processing, or other
16coal or lead mining processes, and abandoned or left in an
17inadequate reclamation status prior to August 3, 1977, and for
18which there is no continuing reclamation responsibility under
19state or federal laws.
20EXPLANATION
21The inclusion of this explanation does not constitute agreement with
22the explanation’s substance by the members of the general assembly.
   23 This bill amends provisions in Code section 207.21, which
24provides for an abandoned coal mine reclamation program
25supported by an abandoned mine reclamation fund administered
26by the division of soil conservation and water quality of
27the department of agriculture and land stewardship. The
28bill requires the division to provide for the reclamation or
29drainage abatement of lead mines and allows the division to
30expend available federal moneys for that purpose.
