3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 481A.123, Code 2021, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  8.  For a public hunting area, as defined in
4subsection 4, under control of the department that is adjacent
5to private property on which the general public does not have
6permission to hunt, the commission shall determine by rule the
7size of a buffer along the border with the private property
8within which a person shall not place a tree stand.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
   12This bill relates to the placement of tree stands on a public
13hunting area. For purposes of the bill, a public hunting
14area is land or water available for hunting by the public
15and identified as a public hunting area by the city, county,
16state, or federal government. Under the bill, if a public
17hunting area under the control of the department of natural
18resources is adjacent to private property on which the general
19public does not have permission to hunt, the natural resource
20commission shall determine by rule the size of a buffer along
21the border with the private property within which a person
22shall not place a tree stand.
   23A violation of the bill is punishable by a scheduled fine of
24$35.
