3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 97B.52A, subsection 1, paragraph c,
2subparagraph (2), Code 2021, is amended by adding the following
3new subparagraph division:
4 NEW SUBPARAGRAPH DIVISION. (d) For a member whose first
5month of entitlement is July 2021 or later, covered employment
6does not include employment as a substitute teacher.
7EXPLANATION
8The inclusion of this explanation does not constitute agreement with
9the explanation’s substance by the members of the general assembly.
10This bill relates to the bona fide retirement of a substitute
11teacher under the Iowa public employees’ retirement system
12(IPERS). Current law provides that a member has a bona fide
13retirement for purposes of IPERS when, among other things,
14the member does not return to covered employment until the
15member has qualified for no fewer than four calendar months
16of retirement benefits. The bill establishes that, for
17purposes of this provision, covered employment does not include
18employment as a substitute teacher. The bill does not modify
19the requirement that the member not return to any employment
20with a covered employer until the member has qualified for at
21least one calendar month of retirement benefits.
