5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 80B.11B, Code 2021, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  4.  The director of the academy, subject
4to the approval of the Iowa state approving agency of the
5department of education, shall amend its administrative
6rules pursuant to chapter 17A to require that the academy’s
7courses of study and training programs meet the requirements
8of nondegree programs under the Post-9/11 Veterans Educational
9Assistance Act of 2008, 38 U.S.C. §3301 et seq., as amended.
10   Sec. 2.  IOWA LAW ENFORCEMENT ACADEMY — APPLICATION TO
11IOWA STATE APPROVING AGENCY.
  The director of the Iowa law
12enforcement academy shall, within thirty days of the effective
13date of this Act, apply to the Iowa state approving agency
14of the department of education for approval of the academy’s
15courses of study and training programs as nondegree programs
16under the Post-9/11 Veterans Educational Assistance Act of
172008.
18   Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of immediate
19importance, takes effect upon enactment.
20EXPLANATION
21The inclusion of this explanation does not constitute agreement with
22the explanation’s substance by the members of the general assembly.
   23This bill relates to courses of study and training programs
24of the Iowa law enforcement academy and federal veterans
25educational assistance benefits.
   26The bill directs the director of the Iowa law enforcement
27academy, subject to the approval of the Iowa state approving
28agency of the department of education, to amend its
29administrative rules to require that the academy’s courses of
30study and training programs meet the requirements of nondegree
31programs under the Post-9/11 Veterans Educational Assistance
32Act of 2008. Under current law, veterans, service members
33on active duty, and spouses and children of veterans who
34died in the line of duty cannot receive reimbursement for
35academy-related educational and training expenses and fees
-1-1under this federal law because the academy does not have
2approved nondegree programs.
   3The bill directs the director of the academy, within 30 days
4of the effective date of the Act, to apply to the Iowa state
5approving agency of the department of education for approval
6of the academy’s courses of study and training programs as
7nondegree programs under the federal law. The Iowa state
8approving agency of the Iowa department of education is
9responsible for approving programs in Iowa eligible to provide
10benefits to individuals under the Post-9/11 Veterans Education
11Assistance Act of 2008.
   12The bill creates an immediate effective date upon enactment.
