3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 692A.101, subsection 1, paragraph a,
2subparagraph (5), Code 2021, is amended to read as follows:
3(5) Assault with intent to commit sexual abuse in violation
4of section 709.11, subsection (1) or (2).
5EXPLANATION
6The inclusion of this explanation does not constitute agreement with
7the explanation’s substance by the members of the general assembly.
8Under current law, convictions for certain criminal
9offenses, including assault with intent to commit sexual abuse
10pursuant to Code section 709.11 regardless of the circumstances
11of the offense, are defined as “aggravated offenses” for
12purposes of the sex offender registry. Upon conviction of an
13aggravated offense, a sex offender is required to register with
14the sex offender registry for life.
15This bill amends the definition of an “aggravated offense”
16to exclude persons convicted of assault with intent to commit
17sexual abuse where there is no resulting injury.
