4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 901C.3, subsection 2, paragraph e, Code
22021, is amended to read as follows:
3e. A conviction under section 321J.2, except for a
4conviction under section 321J.2, subsection 2, paragraph “a”,
5involving a defendant who was twenty-five years of age or
6younger at the time of the offense, and if the offense did not
7involve a serious injury, as defined in section 702.18, to any
8person other than to the defendant.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
12This bill relates to the expungement of an
13operating-while-intoxicated (OWI) offense that is a serious
14misdemeanor under certain circumstances.
15Current law does not allow the expungement of a conviction
16under Code section 321J.2. The bill provides that a conviction
17under Code section 321J.2 that is a serious misdemeanor shall
18not be expunged except for a conviction involving a defendant
19who was 25 years of age or younger at the time of the offense,
20and the offense did not involve a serious injury, as defined in
21Code section 702.18, to any person other than to the defendant.
