5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321.31, Code 2021, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  3.  a.  A person shall not use information
4obtained from the systems maintained under this section,
5including but not limited to by the means described in section
622.3, 321.10, 321.11, 321A.3, or 622.46, for any marketing or
7promotional activity.
   8b.  A person who violates this subsection commits a simple
9misdemeanor.
10EXPLANATION
11The inclusion of this explanation does not constitute agreement with
12the explanation’s substance by the members of the general assembly.
   13This bill restricts the use of information related to
14motor vehicle registration maintained by the department of
15transportation and county treasurers.
   16Under current law, the records systems maintained by the
17department of transportation and each county treasurer’s office
18contain information related to vehicle registration, including
19information related to the vehicle, the vehicle owner, and
20security interests attached to the vehicle.
   21The bill prohibits a person from using the information
22contained in these records systems for any marketing or
23promotional activity. The bill provides that a person who
24violates this provision commits a simple misdemeanor. A simple
25misdemeanor is punishable by confinement for no more than 30
26days and a fine of at least $105 but not more than $855.
