2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 331.301, subsection 16, Code 2021, is
2amended to read as follows:
   316.  a.  The board of supervisors may by ordinance or
4resolution prohibit or limit the use of consumer fireworks or
5display fireworks, as described in section 727.2, if the board
6determines that the use of such devices would constitute a
7threat to public safety or private property, or if the board
8determines that the use of such devices would constitute a
9nuisance to neighboring landowners.
   10b.  The board of supervisors may by ordinance or resolution
11prohibit or limit the sale of any variety of consumer
12fireworks, as described in section 727.2, if the board
13determines there is clear and convincing evidence that the sale
14of such consumer fireworks would constitute a threat to public
15safety or public health.
16   Sec. 2.  Section 364.2, subsection 6, Code 2021, is amended
17to read as follows:
   186.  a.  A city council may by ordinance or resolution
19prohibit or limit the use of consumer fireworks, display
20fireworks, or novelties, as described in section 727.2.
   21b.  A city council may by ordinance or resolution prohibit
22or limit the sale of any variety of consumer fireworks, as
23described in section 727.2, if the city council determines
24there is clear and convincing evidence that the sale of such
25consumer fireworks would constitute a threat to public safety
26or public health.
27EXPLANATION
28The inclusion of this explanation does not constitute agreement with
29the explanation’s substance by the members of the general assembly.
   30This bill relates to consumer fireworks. The bill allows a
31county board of supervisors or a city council to, by ordinance
32or resolution, prohibit or limit the sale of any variety of
33consumer fireworks if the board or city council determines
34there is clear and convincing evidence that the sale of such
35consumer fireworks would constitute a threat to public safety
