3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 331.804, Code 2021, is amended by adding
2the following new subsection:
3 NEW SUBSECTION. 3. The county shall reimburse the funeral
4director for all costs associated with the transportation of
5the body.
6 Sec. 2. IMPLEMENTATION OF ACT. Section 25B.2, subsection
73, shall not apply to this Act.
8EXPLANATION
9The inclusion of this explanation does not constitute agreement with
10the explanation’s substance by the members of the general assembly.
11This bill relates to the costs associated with transporting
12a dead body. The bill requires a county to reimburse a funeral
13director for all costs associated with the transportation of a
14body after an investigation or autopsy has been completed.
15The bill may include a state mandate as defined in Code
16section 25B.3. The bill makes inapplicable Code section 25B.2,
17subsection 3, which would relieve a political subdivision from
18complying with a state mandate if funding for the cost of
19the state mandate is not provided or specified. Therefore,
20political subdivisions are required to comply with any state
21mandate included in the bill.
