3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  479.35  Access points —
2above-ground facilities or fixtures.
   31.  A pipeline company doing business in this state shall
4maintain a record of the global positioning system coordinates
5of all of the following:
   6a.  Access points to the pipeline company’s pipelines and
7underground storage in this state.
   8b.  The pipeline company’s above-ground facilities or
9fixtures in this state that are used to facilitate the
10operation of the pipeline company’s pipelines or underground
11storage.
   122.  A landowner may request that a pipeline company doing
13business in this state provide the landowner with the global
14positioning system coordinates of all access points to the
15pipeline company’s pipelines and underground storage in this
16state located within a right-of-way on the landowner’s property
17and all of the pipeline company’s above-ground facilities or
18fixtures located on the landowner’s property that are used to
19facilitate the operation of the pipeline company's pipelines
20or underground storage. A pipeline company shall provide
21the global positioning system coordinates to the landowner
22pursuant to this subsection within three business days from the
23date of receipt of the landowner’s request. For purposes of
24this subsection, “landowner” means a person listed on the tax
25assessment rolls as responsible for the payment of real estate
26taxes imposed on the property containing the pipeline company’s
27right-of-way.
   283.  The board shall adopt rules pursuant to chapter 17A to
29administer this section.
30   Sec. 2.  NEW SECTION.  479A.3  Access points — above-ground
31facilities or fixtures.
   321.  A pipeline company doing business in this state shall
33maintain a record of the global positioning system coordinates
34of all of the following:
   35a.  Access points to the pipeline company’s pipelines and

   2b.  The pipeline company’s above-ground facilities or
3fixtures in this state that are used to facilitate the
4operation of the pipeline company’s pipelines or underground
5storage.
   62.  A landowner may request that a pipeline company doing
7business in this state provide the landowner with the global
8positioning system coordinates of all access points to the
9pipeline company’s pipelines and underground storage in this
10state located within a right-of-way on the landowner’s property
11and all of the pipeline company’s above-ground facilities or
12fixtures located on the landowner’s property that are used to
13facilitate the operation of the pipeline company’s pipelines
14or underground storage. A pipeline company shall provide
15the global positioning system coordinates to the landowner

24   Sec. 3.  NEW SECTION.  479B.34  Access points — above-ground
25facilities or fixtures.
   261.  A pipeline company doing business in this state shall
27maintain a record of the global positioning system coordinates
28of all of the following:
   29a.  Access points to the pipeline company’s pipelines and
30underground storage in this state.
   31b.  The pipeline company’s above-ground facilities or
32fixtures in this state that are used to facilitate the
33operation of the pipeline company’s pipelines or underground
34storage.
   352.  A landowner may request that a pipeline company doing

2positioning system coordinates of all access points to the
3pipeline company’s pipelines and underground storage in this
4state located within a right-of-way on the landowner’s property
5and all of the pipeline company’s above-ground facilities or
6fixtures located on the landowner’s property that are used to
7facilitate the operation of the pipeline company’s pipelines
8or underground storage. A pipeline company shall provide
9the global positioning system coordinates to the landowner
10pursuant to this subsection within three business days from the
11date of receipt of the landowner’s request. For purposes of
12this subsection, “landowner” means a person listed on the tax
13assessment rolls as responsible for the payment of real estate
14taxes imposed on the property containing the pipeline company’s
15right-of-way.
   163.  The board shall adopt rules pursuant to chapter 17A to
17administer this section.
18EXPLANATION
19The inclusion of this explanation does not constitute agreement with
20the explanation’s substance by the members of the general assembly.
   21This bill relates to pipelines and underground storage.
   22The bill requires pipeline companies governed by Code
23chapter 479 (pipelines and underground gas storage), 479A
24(interstate natural gas pipelines), or 479B (hazardous
25liquid pipelines and storage facilities) doing business in
26this state to maintain a record of the global positioning
27system coordinates of access points to the pipeline company’s
28pipelines and underground storage in this state and the
29pipeline company’s above-ground facilities or fixtures in this
30state that are used to facilitate the operation of the pipeline
31company’s pipelines or underground storage.
   32The bill authorizes a landowner to request that a pipeline
33company provide the landowner with the global positioning
34system coordinates of all access points to the pipeline
35company’s pipelines and underground storage located within
-3-1a right-of-way on the landowner’s property and all of the
2pipeline company’s above-ground facilities or fixtures located
3on the landowner’s property that are used to facilitate the
4operation of the pipeline company’s pipelines or underground
5storage. The bill requires a pipeline company to provide the
6global positioning system coordinates to the landowner within
7three business days of the date the pipeline company receives
8the request.
   9The bill requires the board to adopt rules pursuant to Code
10chapter 17A to administer these provisions.
   11A person who violates a provision of Code chapter 479 is
12subject to a civil penalty not to exceed $100,000 for each
13violation or $1 million for any related series of violations.
14A person who violates a provision of Code chapter 479B is
15subject to a civil penalty not to exceed $1,000 for each
16violation or $200,000 for any related series of violations.
