3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321.393, subsections 4 and 5, Code 2021,
2are amended to read as follows:
   34.  The provisions of this section shall not prohibit the
4use of a lighting device or reflector displaying an amber light
5when such lighting device or reflector is mounted on a motor
6truck, trailer, tractor, or motor grader owned by the state,
7or any political subdivision of the state, or any municipality
8therein
 including any local authority, while such equipment is
9being used for snow removal, sanding, maintenance, or repair of
10the public streets or highways.
   115.  The provisions of this section shall not prohibit the
12use of a lighting device or reflector displaying an amber,
13white, or blue light when the lighting device or reflector is
14rear-facing and mounted on a motor truck, trailer, tractor,
15truck-mounted snow blower, or motor grader owned by the
16department state or any political subdivision of the state,
17including any local authority,
while the equipment is being
18used for snow and ice treatment or removal on the public
19streets or highways.
20   Sec. 2.  Section 321.423, subsection 3, paragraph a,
21subparagraph (4), Code 2021, is amended to read as follows:
   22(4)  A motor truck, trailer, tractor, truck-mounted snow
23blower, or motor grader owned by the department state or
24any political subdivision of the state, including any local
25authority,
if the blue light is rear-facing and used in
26conjunction with amber and white lighting devices or reflectors
27while the equipment is being used for snow and ice treatment or
28removal on the public streets or highways.
29   Sec. 3.  Section 321.423, subsection 7, paragraph a,
30subparagraph (4), Code 2021, is amended to read as follows:
   31(4)  On a motor truck, trailer, tractor, truck-mounted
32snow blower, or motor grader owned by the department state or
33any political subdivision of the state, including any local
34authority,
if the white light is rear-facing and used in
35conjunction with amber and blue lighting devices or reflectors
-1-1while the equipment is being used for snow and ice treatment or
2removal on the public streets or highways.
3EXPLANATION
4The inclusion of this explanation does not constitute agreement with
5the explanation’s substance by the members of the general assembly.
   6In 2015, the general assembly authorized motor trucks,
7trailers, tractors, truck-mounted snow blowers, and motor
8graders owned by the department of transportation and used for
9snow and ice treatment or removal to display rear-facing blue
10and white lighting devices or reflectors in conjunction with
11amber lighting devices or reflectors. These authorizations
12were set to be repealed July 1, 2019. In 2018, the general
13assembly struck these future repeal provisions.
   14This bill applies those authorizations to such vehicles
15owned by the state or any political subdivision of the
16state, including any local authority. Under Code chapter
17321, a “local authority” is any county, municipal, and other
18local board or body having authority to adopt local police
19regulations under the constitution and laws of the state.
   20Under current law, a violation of Code section 321.393 is
21punishable by a scheduled fine of $30 and a violation of Code
22section 321.423 is punishable by a scheduled fine of $45.
