3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 331.301, subsection 6, Code 2021, is
2amended by adding the following new paragraph:
3   NEW PARAGRAPH.  e.  (1)  A county shall not adopt or
4enforce an ordinance, motion, resolution, or amendment that
5bans a person from owning a specific breed of dog, including
6through an ordinance, motion, resolution, or amendment based
7on physical, behavioral, or genetic features that in effect
8would ban a person from owning a specific breed of dog. For
9purposes of this paragraph, “dog” means a domestic dog or the
10offspring of a domestic dog and a wolf, or the offspring from
11each subsequent generation in which at least one parent is a
12domestic dog.
   13(2)  An ordinance, motion, resolution, or amendment adopted
14prior to the effective date of this Act that violates this
15paragraph is void and unenforceable on and after the effective
16date of this Act.
17   Sec. 2.  Section 364.3, subsection 3, Code 2021, is amended
18by adding the following new paragraph:
19   NEW PARAGRAPH.  e.  (1)  A city shall not adopt or enforce an
20ordinance, motion, resolution, or amendment that bans a person
21from owning a specific breed of dog, including through an
22ordinance, motion, resolution, or amendment based on physical,
23behavioral, or genetic features that in effect would ban a
24person from owning a specific breed of dog. For purposes of
25this paragraph, “dog” means a domestic dog or the offspring of a
26domestic dog and a wolf, or the offspring from each subsequent
27generation in which at least one parent is a domestic dog.
   28(2)  An ordinance, motion, resolution, or amendment adopted
29prior to the effective date of this Act that violates this
30paragraph is void and unenforceable on and after the effective
31date of this Act.
32EXPLANATION
33The inclusion of this explanation does not constitute agreement with
34the explanation’s substance by the members of the general assembly.
   35This bill prohibits cities and counties from adopting or

4on physical, behavioral, or genetic features that in effect
5would ban a person from owning a specific breed of dog. The

7domestic dog and a wolf, or the offspring from each subsequent
8generation in which at least one parent is a domestic dog. An
9ordinance, motion, resolution, or amendment adopted prior to
10the effective date of the bill that violates the prohibition
11is void and unenforceable on and after the effective date of
12the bill.
