3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  DEPARTMENT OF HUMAN SERVICES — INPATIENT
2PSYCHIATRIC BED TRACKING SYSTEM.
  The department of human
3services shall amend its administrative rules pursuant to
4chapter 17A to require state mental health institutes and
5hospitals licensed to provide inpatient psychiatric treatment
6to provide for all of the following:
   71.  Update the inpatient psychiatric bed tracking system to
8indicate when an inpatient psychiatric bed becomes available
9within twenty-four hours of the bed becoming available. For
10each bed that becomes available, the updates to the psychiatric
11bed tracking system shall indicate all of the following:
   12a.  If the bed is available for a child or an adult including
13a geriatric adult.
   14b.  If the bed is available for a person with a co-occurring
15mental illness and substance-related disorder.
   16c.  If the bed is available for a person currently under the
17influence of drugs or alcohol.
   18d.  If the bed is available for a person who is currently
19exhibiting aggressive behavior toward the person’s self or
20others.
   21e.  If the bed is available for men, women, or both.
   222.  Allow authorized users of the psychiatric bed tracking
23system to reserve an open bed on the psychiatric bed tracking
24system if the authorized user is attempting to admit a person
25to a state mental health institute or a hospital and that
26person meets all of the requirements specified in paragraph “a”
27for the open bed. The rules shall provide that a mental health
28institute or hospital with a reservation for an open bed must
29admit the person for which an open bed was reserved, unless
30the person does not meet all of the requirements specified in
31paragraph “a” as indicated in the psychiatric bed tracking
32system, or unless the mental health institute or hospital is
33required to provide the open bed to another person pursuant
34to the Emergency Medical Treatment and Labor Act or any other
35similar superseding federal authority.

1EXPLANATION
2The inclusion of this explanation does not constitute agreement with
3the explanation’s substance by the members of the general assembly.
   4This bill relates to the inpatient psychiatric bed tracking
5system.
   6The bill directs the department of human services to amend
7its administrative rules to require a hospital that has
8inpatient psychiatric beds to update the inpatient psychiatric
9bed tracking system to indicate when an inpatient psychiatric
10bed becomes available within 24 hours of the bed becoming
11available. For each bed that becomes available, the updates
12to the psychiatric bed tracking system must indicate the
13following: if the bed is available for a child or an adult
14including a geriatric adult; if the bed is available for a
15person with a co-occurring mental illness and substance-related
16disorder; if the bed is available for a person currently under
17the influence of drugs or alcohol; if the bed is available for
18a person who is currently exhibiting aggressive behavior toward
19the person’s self or others; and if the bed is available to
20men, women, or both.
   21The bill requires mental health institutes and hospitals to
22allow authorized users of the psychiatric bed tracking system
23to reserve an open bed on the psychiatric bed tracking system
24if the authorized user is seeking to admit a person who meets
25all requirements specified by the mental health institute or
26hospital in the psychiatric bed tracking system for the open
27bed.
   28The bill requires a mental health institute or hospital with
29a reservation for an open bed to admit a person for which an
30open bed was reserved, unless that person does not meet all of
31the requirements specified by the mental health institute or
32hospital as indicated in the psychiatric bed tracking system
33for the open bed, or unless the mental health institute or
34hospital is required to provide the open bed to another person
35pursuant to the Emergency Medical Treatment and Labor Act or
