2supplementary weighting for school districts and including
3effective date and applicability provisions.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 257.11, subsection 5, paragraph a, Code
22021, is amended to read as follows:
   3a.  (1)  In order to provide additional funding to increase
4student opportunities and redirect more resources to student
5programming for school districts that share operational
6functions, a district that shares with a political subdivision
7one or more operational functions of a curriculum director,
 8school resource officer, master social worker, independent
9social worker, or school counselor, or one or more operational
10functions in the areas of superintendent management, business
11management, human resources, transportation, or operation
12and maintenance for at least twenty percent of the school
13year shall be assigned a supplementary weighting for each
14shared operational function. A school district that shares an
15operational function in the area of superintendent management
16shall be assigned a supplementary weighting of eight pupils for
17the function. A school district that shares the operational
18functions of a school resource officer or that
shares an
19operational function in the area of business management, human
20resources, transportation, or operation and maintenance shall
21be assigned a supplementary weighting of five pupils for the
22function. A school district that shares the operational
23functions of a curriculum director, a master social worker or
24an independent social worker licensed under chapters 147 and
25154C, or a school counselor shall be assigned a supplementary
26weighting of three pupils for the function. The additional
27weighting shall be assigned for each discrete operational
28function shared. However, a school district may receive the
29additional weighting under this subsection for sharing the
30services of an individual with a political subdivision even if
31the type of operational function performed by the individual
32for the school district and the type of operational function
33performed by the individual for the political subdivision are
34not the same operational function, so long as both operational
35functions are eligible for weighting under this subsection. In
-1-1such case, the school district shall be assigned the additional
2weighting for the type of operational function that the
3individual performs for the school district, and the school
4district shall not receive additional weighting for any other
5function performed by the individual. The operational function
6sharing arrangement does not need to be a newly implemented
7sharing arrangement to receive supplementary weighting under
8this subsection.
   9(2)  For the purposes of this section, “political
10subdivision”
:
   11(a)   “Political subdivision”means a city, township, county,
12school corporation, merged area, area education agency,
13institution governed by the state board of regents, or any
14other governmental subdivision.
   15(b)  “School resource officer” means the same as defined in
1634 U.S.C. §10389.
17   Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of immediate
18importance, takes effect upon enactment.
19   Sec. 3.  APPLICABILITY.  This Act applies to school budget
20years beginning on or after July 1, 2021, subject to the school
21budget year limitations of section 257.11, subsection 5.
22EXPLANATION
23The inclusion of this explanation does not constitute agreement with
24the explanation’s substance by the members of the general assembly.
   25Code section 257.11(5) provides supplementary weighting
26for school districts and area education agencies that share
27specified operational functions for at least 20 percent of the
28school year. Supplementary weighting under this provision is
29available for school budget years beginning on or after July 1,
302021, through the budget year beginning July 1, 2024.
   31This bill adds a school resource officer to the list of
32eligible operational functions and positions eligible for a
33supplementary weighting of five pupils. The bill defines
34“school resource officer” to mean the same as the federal
35definition. The federal definition of “school resource
-2-1officer” is a career law enforcement officer, with sworn
2authority, deployed in community-oriented policing, and
3assigned by the employing police department or agency to work
4in collaboration with schools and community-based organizations
5to address crime and disorder problems, gangs, and drug
6activities affecting or occurring in or around an elementary
7or secondary school; to develop or expand crime prevention
8efforts for students; to educate likely school-age victims in
9crime prevention and safety; to develop or expand community
10justice initiatives for students; to train students in conflict
11resolution, restorative justice, and crime awareness; to assist
12in the identification of physical changes in the environment
13that may reduce crime in or around the school; and to assist in
14developing school policy that addresses crime and to recommend
15procedural changes.
   16The bill takes effect upon enactment and applies to school
17budget years beginning on or after July 1, 2021, through the
18school budget year beginning July 1, 2024.
