3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  314.32  Road salt use reduction
2programs.
   31.  As used in this section, unless the context otherwise
4requires:
   5a.  “Road salt” means sodium chloride, calcium chloride,
6magnesium chloride, or any other substance containing chloride
7used to treat or control the accumulation of ice and snow on
8highways and streets.
   9b.  “Winter season” means November 1 through May 31.
   102.  Each agency shall create a road salt use reduction
11program within its jurisdiction. Under the program, the agency
12shall reduce the amount of road salt used on the highways and
13streets under its jurisdiction and control at a rate of five
14percent per winter season for five winter seasons beginning
15with the winter season commencing on November 1, 2021. The
16required five percent reduction in road salt use shall be
17measured against the amount of road salt used by the agency
18during the preceding winter season, except that the reduction
19required for the first winter season of the program shall be
20measured against the amount of road salt used by the agency in
21the winter season commencing on November 1, 2019.
   223.  Each agency shall proportionally increase its use of
23organic additives, including the byproducts of midwestern-grown
24renewable crops, to treat or control the accumulation of ice
25and snow on highways and streets such that no decrease in the
26effectiveness of snow and ice treatment or control occurs.
   274.  If an agency fails to meet the required five percent
28reduction in road salt used in any winter season, that agency
29shall add the amount of the shortfall to the following winter
30season’s required reduction, increasing the percentage target
31accordingly.
   325.  a.  A county, city, or other municipality subject to the
33program requirements set forth in this section shall certify
34and file a report with the department on or before June 30
35following each winter season in which it is required to reduce
-1-1road salt use under its program. The department shall also
2create a report on or before June 30 following each winter
3season in which it is required to reduce road salt use under
4its program. The reports required by this paragraph shall
5include all of the following:
   6(1)  The amount of road salt used by the agency during the
7most recent winter season.
   8(2)  The amount of road salt used by the agency during the
9winter season preceding the most recent winter season, except
10that the report required following the first winter season of
11the program shall include the amount of road salt used by the
12agency during the winter season commencing on November 1, 2019.
   13(3)  The percentage difference between the amount reported
14pursuant to subparagraph (1) and the amount reported pursuant
15to subparagraph (2).
   16b.  On or before July 31 following each winter season
17in which an agency is required to create a report pursuant
18to paragraph “a”, the department shall compile its report
19and the reports received from counties, cities, and other
20municipalities pursuant to paragraph “a” into a cumulative
21report and submit the cumulative report in electronic format
22to the chairpersons of the senate and house of representatives
23standing committees on transportation and the legislative
24services agency.
25   Sec. 2.  IMPLEMENTATION OF ACT.  Section 25B.2, subsection
263, shall not apply to this Act.
27EXPLANATION
28The inclusion of this explanation does not constitute agreement with
29the explanation’s substance by the members of the general assembly.
   30This bill requires each agency, meaning a governmental body
31which exercises jurisdiction over any road as provided by law,
32including the department of transportation (DOT), to create
33a road salt use reduction program. Under the program, each
34agency must reduce the amount of road salt used on the highways
35and streets under its jurisdiction and control at a rate of 5
-2-1percent per winter season for five winter seasons beginning
2with the winter season commencing on November 1, 2021. The 5
3percent reduction is measured against the amount of road salt
4used by the agency during the preceding winter season, except
5that the reduction required for the winter season commencing on
6November 1, 2021, is measured against the amount of road salt
7used in the winter season commencing on November 1, 2019. The
8bill defines the terms “road salt” and “winter season”.
   9The bill requires each agency to proportionally increase
10its use of organic additives, including the byproducts of
11midwestern-grown renewable crops, to treat or control the
12accumulation of ice and snow on highways and streets such that
13no decrease in the effectiveness of snow and ice treatment or
14control occurs.
   15An agency that fails to meet the required 5 percent reduction
16in road salt use in any winter season must add the amount of the
17shortfall to the following winter season’s required reduction.
   18A county, city, or other municipality subject to the program
19requirements of the bill must file a report with the DOT on
20or before June 30 following each winter season in which it
21is required to reduce road salt use under its program. The
22DOT must also create a report on or before June 30 following
23each winter season in which it is required to reduce road salt
24use under its program. The reports required by the bill must
25include the amount of road salt used by the agency during the
26most recent winter season; the amount of road salt used during
27the winter season preceding the most recent winter season,
28except the report required following the first winter season
29of the program shall include the amount of road salt used by
30the agency during the winter season commencing in 2019; and the
31percentage difference between the two amounts. On or before
32July 31 following each winter season, the DOT must then compile
33its report and the reports received from counties, cities, and
34other municipalities into a cumulative report and submit the
35cumulative report to the chairpersons of the senate and house
-3-1of representatives standing committees on transportation and
2the legislative services agency.
   3The bill may include a state mandate as defined in Code
4section 25B.3. The bill makes inapplicable Code section 25B.2,
5subsection 3, which would relieve a political subdivision from
6complying with a state mandate if funding for the cost of
7the state mandate is not provided or specified. Therefore,
8political subdivisions are required to comply with any state
9mandate included in the bill.
