2heart recipients and wounded veterans, providing penalties,
3and making penalties applicable.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321L.1, Code 2021, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  9.  “Purple heart recipients and wounded
4veterans municipal meters parking permit”
means a permit issued
5by the department that allows the holder to park in a metered
6parking space, either on-street or off-street, operated or
7maintained by a city, and includes all of the following:
   8a.  A purple heart special registration plate issued under
9section 321.34, subsection 18, to or for a person who was
10awarded a purple heart medal by the United States government
11for wounds received in military or naval combat against an
12armed enemy of the United States.
   13b.  A purple heart recipients and wounded veterans removable
14windshield municipal meters parking placard which is a
15two-sided placard for hanging from the rearview mirror when
16the motor vehicle is parked in a metered parking space, either
17on-street or off-street, operated or maintained by a city.
18   Sec. 2.  NEW SECTION.  321L.11  Purple heart recipients and
19wounded veterans — removable windshield municipal meters parking
20placards — application and issuance.
   211.  A resident of the state who is a veteran and who
22was awarded a purple heart medal by the United States
23government for wounds received in military or naval combat
24against an armed enemy of the United States, or who has a
25service-connected disability rating by the United States
26department of veterans affairs, desiring a removable windshield
27municipal meters parking placard may apply to the department
28upon an application form furnished by the department providing
29the applicant’s full legal name, address, date of birth,
30social security number or Iowa driver’s license number or Iowa
31nonoperator’s identification card number, and proof of receipt
32of the purple heart medal or certification from the United
33States department of veterans affairs stating the nature of the
34applicant’s service-connected disability rating, as applicable.
35Upon receiving a valid application, the department shall issue
-1-1one removable windshield municipal meters parking placard to
2the applicant.
   32.  The removable windshield municipal meters parking
4placard shall contain all of the following information:
   5a.  Each side of the placard shall include all of the
6following:
   7(1)  A symbol approved for use by the department to designate
8purple heart recipients and wounded veterans which is at least
9three inches in height and centered on the placard.
   10(2)  An identification number.
   11(3)  The seal or other identification of the issuing
12authority.
   13b.  One side of the placard shall contain all of the
14following information:
   15(1)  A statement printed on it as follows:
16Remove from mirror before operating vehicle.
   17(2)  The return address and telephone number of the
18department.
   19(3)  The signature of the person who has been issued the
20placard.
   213.  A removable windshield municipal meters parking placard
22shall only be displayed when the vehicle is parked in a metered
23parking space, either on-street or off-street, operated or
24maintained by a city. The placard shall be displayed in a
25manner that allows the entire placard to be visible through the
26vehicle’s windshield.
   274.  The department shall issue a new removable windshield
28municipal meters parking placard if the previously issued
29placard is reported lost, stolen, or damaged. A placard
30reported lost or stolen shall be invalidated by the department.
31A placard which is damaged shall be returned to the department
32and exchanged for a new placard in accordance with rules
33adopted by the department.
   345.  Any person providing false information with the intent to
35defraud on the application for a removable windshield municipal
-2-1meters parking placard used in establishing proof under
2subsection 1 is subject to a civil penalty of three hundred
3dollars which may be imposed by the department. In addition
4to the civil penalty, the department shall revoke the placard
5issued pursuant to this section.
6   Sec. 3.  NEW SECTION.  321L.12  Return of purple heart
7recipients and wounded veterans municipal meters parking
8placards.
   91.  Purple heart recipients and wounded veterans municipal
10meters parking placards shall be returned to the department
11upon the occurrence of any of the following:
   12a.  The person to whom the placard has been issued is
13deceased.
   14b.  The person to whom the placard has been issued has moved
15out of state.
   16c.  A person has found or has in the person’s possession a
17purple heart recipients and wounded veterans municipal meters
18parking placard that was not issued to that person.
   19d.  The placard has been revoked.
   20e.  The placard reported lost or stolen is later found
21or retrieved after a subsequent purple heart recipients and
22wounded veterans municipal meters parking placard has been
23issued.
   242.  A person who fails to return a purple heart recipients
25and wounded veterans municipal meters parking placard and
26subsequently misuses the placard by illegally parking in a
27metered parking space, either on-street or off-street, operated
28or maintained by a city is guilty of a simple misdemeanor
29punishable as a scheduled violation under section 805.8A,
30subsection 1, paragraph “c”.
   313.  Purple heart recipients and wounded veterans municipal
32meters parking placards may be returned to the department as
33required by this section directly to the department, to a
34driver’s license station, or to any law enforcement office.
35   Sec. 4.  NEW SECTION.  321L.13  Purple heart recipients and
-3-1wounded veterans municipal meters parking — display and use of
2permit.
   31.  A purple heart recipients and wounded veterans municipal
4meters parking permit allows the holder to park a vehicle
5at parking meters operated and maintained by a city, either
6on-street or off-street, for free for a period not to exceed
7twenty-four hours. The holder and the holder’s vehicle are
8not subject to enforcement of any ordinance related to parking
9meter fees at such parking meters during the applicable
10twenty-four-hour period.
   112.  A purple heart recipients and wounded veterans municipal
12meters parking permit shall be displayed in a motor vehicle
13as a removable windshield placard or on a vehicle as a purple
14heart special registration plate when being used by a purple
15heart recipient or wounded veteran, either as an operator or
16passenger. Each removable windshield placard shall be of
17uniform design and fabricated of durable material, suitable
18for display from within the passenger compartment of a motor
19vehicle, and readily transferable from one vehicle to another.
20The placard shall only be displayed when the motor vehicle
21is parked in a metered parking space, either on-street or
22off-street, operated or maintained by a city.
   233.  The use of a metered parking space, either on-street or
24off-street, operated or maintained by a city by an operator
25of a vehicle displaying a purple heart recipients and wounded
26veterans municipal meters parking permit but not being used by
27a person issued the permit constitutes improper use of a purple
28heart recipients and wounded veterans municipal meters parking
29permit, which is a simple misdemeanor punishable as a scheduled
30violation under section 805.8A, subsection 1, paragraph
31“c”. Proof of conviction of two or more violations involving
32improper use of a purple heart recipients and wounded veterans
33municipal meters parking permit is grounds for revocation
34by the court or the department of the holder’s privilege to
35possess or use the parking permit.

   14.  A peace officer as designated in section 801.4,
2subsection 11, shall have the authority to and shall enforce
3the provisions of this section on public and private property.
4   Sec. 5.  NEW SECTION.  321L.14  Purple heart recipients and
5wounded veterans municipal meters parking permits and parking —
6rules.
   7The department, pursuant to chapter 17A, shall adopt rules
8relating to all of the following:
   91.  Establishing procedures for applying to the department
10for issuance of purple heart recipients and wounded veterans
11municipal meters parking placards under this chapter, including
12but not limited to rules detailing the requirements for
13acceptable proof of receipt of the purple heart medal or
14certification of a service-connected disability rating.
   152.  Governing the manner in which purple heart recipients
16and wounded veterans municipal meters parking permits are to be
17displayed in or on motor vehicles.
   183.  Regarding enforcement of this chapter.
19   Sec. 6.  Section 364.3, Code 2021, is amended by adding the
20following new subsection:
21   NEW SUBSECTION.  13.  A city that operates and maintains
22parking meters, either on-street or off-street, shall not
23enforce any ordinance related to parking meter fees at such
24parking meters against a person whose vehicle is lawfully
25bearing purple heart special registration plates issued
26pursuant to section 321.34, subsection 18, or displaying a
27purple heart recipients and wounded veterans municipal meters
28parking placard issued pursuant to section 321L.11, during the
29first twenty-four hours the vehicle is parked.
30   Sec. 7.  Section 805.8A, subsection 1, paragraph c, Code
312021, is amended to read as follows:
   32c.  For violations under section 321L.2A, subsection 3,
33sections section 321L.3, section 321L.4, subsection 2, and
34section sections 321L.7, 321L.12, and 321L.13, the scheduled
35fine is two hundred dollars.

1EXPLANATION
2The inclusion of this explanation does not constitute agreement with
3the explanation’s substance by the members of the general assembly.
   4This bill creates a new parking permit that allows purple
5heart recipients and wounded veterans with a service-connected
6disability rating by the United States department of veterans
7affairs to park in city-operated and maintained metered parking
8spaces, either on-street or off-street, free of charge for
9up to 24 hours. The bill defines the term “purple heart
10recipients and wounded veterans municipal meters parking
11permit” to include both purple heart special registration
12plates and a new removable windshield placard.
   13The bill requires the department of transportation (DOT) to
14create the new removable windshield placard for purple heart
15recipients and wounded veterans. The bill specifies certain
16placard requirements similar to the requirements under current
17law for persons with disabilities placards. An applicant is
18eligible to receive one removable windshield placard. There is
19no fee for the issuance of a removable windshield placard.
   20The bill requires purple heart recipients and wounded
21veterans municipal meters parking placards to be returned to
22the DOT when the person to whom the placard was issued is
23deceased or has moved out of state, a person finds or possesses
24a placard not issued to that person, the placard has been
25revoked, or when the placard reported lost or stolen is later
26found or retrieved after a subsequent placard has been issued.
   27The bill proscribes proper display and use requirements for
28a purple heart recipients and wounded veterans municipal meters
29parking permit.
   30The bill prohibits a city that operates and maintains
31parking meters, either on-street or off-street, from enforcing
32any ordinance related to parking meter fees against a person
33whose vehicle is lawfully bearing purple heart special
34registration plates or displaying a purple heart recipients and
35wounded veterans municipal meters parking placard during the
-6-1first 24 hours the vehicle is parked.
   2A person who provides false information with the intent to
3defraud on the application for a purple heart recipients and
4wounded veterans municipal meters parking placard is subject to
5a civil penalty of $300.
   6A person who fails to return a purple heart recipients
7and wounded veterans municipal meters parking placard and
8subsequently misuses the placard commits a simple misdemeanor
9punishable by a scheduled fine of $200. Misuse of a purple
10heart recipients and wounded veterans municipal meters parking
11permit by a person who was not issued the permit also commits
12a simple misdemeanor punishable by a scheduled fine of $200.
13Proof of conviction of two or more violations involving
14improper use of a purple heart recipients and wounded veterans
15municipal meters parking permit is grounds for the court or
16the DOT to revoke the holder’s privilege to possess or use the
17parking permit.
