3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  29C.7  Hazard mitigation financial
2assistance.
   31.  If financial assistance is granted by the federal
4government under the federal Robert T. Stafford Disaster Relief
5and Emergency Assistance Act, Pub.L. No.93-288, as amended,
642 U.S.C. 5121 et seq.or the federal National Flood Insurance
7Reform Act of 1994, Pub.L. No.103-325, 42 U.S.C. 4001 et seq.
8for hazard mitigation and section 29C.6 is not applicable,
9the state may participate in the funding of the financial
10assistance authorized to a local government in an amount not
11to exceed ten percent of the eligible expenses, with the
12applicant providing the balance of any participation amount.
13If financial assistance is granted by the federal government as
14described in this section for state-related hazard mitigation,
15the state may participate in the funding of the financial
16assistance authorized, not to exceed fifty percent of the total
17eligible expenses.
   182.  State participation in funding financial assistance to
19local government under subsection 1 is contingent upon the
20local government having on file a state-approved, comprehensive
21emergency plan which meets the standards adopted pursuant to
22section 29C.9, subsection 8.
23EXPLANATION
24The inclusion of this explanation does not constitute agreement with
25the explanation’s substance by the members of the general assembly.
   26This bill concerns financial assistance granted by the
27federal government for hazard mitigation when Code section
2829C.6, relating to a proclamation of disaster emergency by the
29governor, is not applicable.
   30The bill provides that if financial assistance for hazard
31mitigation is granted under the federal Robert T. Stafford
32Disaster Relief and Emergency Assistance Act or the federal
33National Flood Insurance Reform Act of 1994, the state may
34participate in the funding of the financial assistance
35authorized to a local government in an amount not to exceed
-1-110 percent of the eligible expenses. In addition, the
2bill provides that if financial assistance is granted for
3state-related hazard mitigation, the state may participate
4in the funding in an amount not to exceed 50 percent of the
5total eligible expenses. The bill further provides that state
6participation in funding financial assistance to a local
7government is contingent upon the local government having a
8state-approved comprehensive emergency plan.
