3trust fund.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321.34, subsection 16, paragraph a, Code
22020, is amended to read as follows:
   3a.  An owner referred to in subsection 12 who is a member
4of the national guard, as defined in chapter 29A, may,
5upon written application to the department, order special
6registration plates with a national guard processed emblem
7with the emblem designed by the department in cooperation
8with the adjutant general which emblem signifies that the
9applicant is a member of the national guard. The application
10shall be approved by the department in consultation with the
11adjutant general. The special plate fees collected by the
12director under subsection 12, paragraph“a”, from the annual
13validation of letter-number designated national guard plates,
14and subsection 12, paragraph “c”, from the issuance and annual
15validation of personalized national guard plates shall be paid
16monthly to the treasurer of state and deposited in the road
17use tax fund. The treasurer of state shall transfer monthly
18from the statutory allocations fund created under section
19321.145, subsection 2, to the veterans license fee trust fund
20created in section 35A.11 35A.13 the amount of the special fees
21collected under subsection 12, paragraph “a”, in the previous
22month for national guard plates. Special registration plates
23with a national guard processed emblem shall be surrendered, as
24provided in subsection 12, in exchange for regular registration
25plates upon termination of the owner’s membership in the active
26national guard.
27   Sec. 2.  Section 321.34, subsection 17, paragraph a, Code
282020, is amended to read as follows:
   29a.  An owner referred to in subsection 12 who was at Pearl
30Harbor, Hawaii, as a member of the armed services of the United
31States on December 7, 1941, may, upon written application
32to the department, order special registration plates with a
33Pearl Harbor processed emblem. The emblem shall be designed
34by the department in consultation with service organizations.
35The application is subject to approval by the department.

2subsection 12, paragraph“a”, from the annual validation of
3letter-number designated Pearl Harbor plates, and subsection
412, paragraph “c”, from the issuance and annual validation of
5personalized Pearl Harbor plates shall be paid monthly to the
6treasurer of state and deposited in the road use tax fund. The
7treasurer of state shall transfer monthly from the statutory
8allocations fund created under section 321.145, subsection
92, to the veterans license fee trust fund created in section
1035A.11 35A.13 the amount of the special fees collected under
11subsection 12, paragraph “a”, in the previous month for Pearl
12Harbor plates.
13   Sec. 3.  Section 321.34, subsection 18, paragraph a, Code
142020, is amended to read as follows:
   15a.  An owner referred to in subsection 12 who was awarded
16a purple heart medal by the United States government for
17wounds received in military or naval combat against an armed
18enemy of the United States may, upon written application to
19the department and presentation of satisfactory proof of the
20award of the purple heart medal, order special registration
21plates with a purple heart processed emblem. The design of
22the emblem shall include a representation of a purple heart
23medal and ribbon. The application is subject to approval by
24the department in consultation with the adjutant general.
25The special plate fees collected by the director under
26subsection 12, paragraph“a”, from the annual validation of
27letter-number designated purple heart plates, and subsection
2812, paragraph “c”, from the issuance and annual validation of
29personalized purple heart plates shall be paid monthly to the
30treasurer of state and deposited in the road use tax fund. The
31treasurer of state shall transfer monthly from the statutory
32allocations fund created under section 321.145, subsection
332, to the veterans license fee trust fund created in section
3435A.11 35A.13 the amount of the special fees collected under
35subsection 12, paragraph “a”, in the previous month for purple

2   Sec. 4.  Section 321.34, subsection 19, paragraph a, Code
32020, is amended to read as follows:
   4a.  An owner referred to in subsection 12 who is a retired
5member of the United States armed forces may, upon written
6application to the department and upon presentation of
7satisfactory proof of membership, order special registration
8plates with a United States armed forces retired processed
9emblem. The emblem shall be designed by the department in
10consultation with service organizations. The application is
11subject to approval by the department. For purposes of this
12subsection, a person is considered to be retired if the person
13is recognized by the United States armed forces as retired
14from the United States armed forces. The special plate fees
15collected by the director under subsection 12, paragraph“a”,
16from the annual validation of letter-number designated armed
17forces retired plates, and subsection 12, paragraph “c”, from
18the issuance and annual validation of personalized armed forces
19retired plates shall be paid monthly to the treasurer of state
20and deposited in the road use tax fund. The treasurer of state
21shall transfer monthly from the statutory allocations fund
22created under section 321.145, subsection 2, to the veterans
23license fee trust fund created in section 35A.11 35A.13 the
24amount of the special fees collected under subsection 12,
25paragraph “a”, in the previous month for armed forces retired
26plates.
27   Sec. 5.  Section 321.34, subsection 20, paragraph a, Code
282020, is amended to read as follows:
   29a.  An owner referred to in subsection 12 who was awarded a
30silver or a bronze star by the United States government, may,
31upon written application to the department and presentation
32of satisfactory proof of the award of the silver or bronze
33star, order special registration plates with a silver or bronze
34star processed emblem. The emblem shall be designed by the
35department in consultation with the adjutant general. The
-3-1special plate fees collected by the director under subsection
212, paragraph“a”, from the annual validation of letter-number
3designated silver star and bronze star plates, and subsection
412, paragraph “c”, from the issuance and annual validation of
5personalized silver star and bronze star plates shall be paid
6monthly to the treasurer of state and deposited in the road use
7tax fund. The treasurer of state shall transfer monthly from
8the statutory allocations fund created under section 321.145,
9subsection 2, to the veterans license fee trust fund created in
10section 35A.11 35A.13 the amount of the special fees collected
11under subsection 12, paragraph “a”, in the previous month for
12silver star and bronze star plates.
13   Sec. 6.  Section 321.34, subsection 20A, paragraph a, Code
142020, is amended to read as follows:
   15a.  An owner referred to in subsection 12 who was awarded
16a distinguished service cross, a navy cross, or an air force
17cross by the United States government may, upon written
18application to the department and presentation of satisfactory
19proof of the award, order special registration plates with
20a distinguished service cross, navy cross, or air force
21cross processed emblem. The emblem shall be designed by the
22department in consultation with the adjutant general. The
23special plate fees collected by the director under subsection
2412, paragraph“a”, from the annual validation of letter-number
25designated distinguished service cross, navy cross, and air
26force cross plates, and subsection 12, paragraph “c”, from the
27issuance and annual validation of personalized distinguished
28service cross, navy cross, and air force cross plates shall
29be paid monthly to the treasurer of state and deposited in
30the road use tax fund. The treasurer of state shall transfer
31monthly from the statutory allocations fund created under
32section 321.145, subsection 2, to the veterans license fee
33
 trust fund created in section 35A.11 35A.13 the amount of the
34special fees collected under subsection 12, paragraph “a”, in
35the previous month for distinguished service cross, navy cross,

2   Sec. 7.  Section 321.34, subsection 20B, paragraph a, Code
32020, is amended to read as follows:
   4a.  An owner referred to in subsection 12 who was awarded a
5soldier’s medal, a navy and marine corps medal, or an airman’s
6medal by the United States government may, upon written
7application to the department and presentation of satisfactory
8proof of the award, order special registration plates with
9a soldier’s medal, navy and marine corps medal, or airman’s
10medal processed emblem. The emblem shall be designed by the
11department in consultation with the adjutant general. The
12special plate fees collected by the director under subsection
1312, paragraph“a”, from the annual validation of letter-number
14designated soldier’s medal, navy and marine corps medal, and
15airman’s medal plates, and subsection 12, paragraph “c”, from
16the issuance and annual validation of personalized soldier’s
17medal, navy and marine corps medal, and airman’s medal plates
18shall be paid monthly to the treasurer of state and deposited
19in the road use tax fund. The treasurer of state shall
20transfer monthly from the statutory allocations fund created
21under section 321.145, subsection 2, to the veterans license
22fee
 trust fund created in section 35A.11 35A.13 the amount of
23the special fees collected under subsection 12, paragraph “a”,
24in the previous month for soldier’s medal, navy and marine
25corps medal, and airman’s medal plates.
26   Sec. 8.  Section 321.34, subsection 20C, paragraph b, Code
272020, is amended to read as follows:
   28b.  An owner referred to in subsection 12 who was awarded a
29combat infantryman badge, combat action badge, combat action
30ribbon, air force combat action medal, or combat medical
31badge by the United States government may, upon written
32application to the department and presentation of satisfactory
33proof of the award, order special registration plates with a
34combat infantryman badge, combat action badge, combat action
35ribbon, air force combat action medal, or combat medical badge
-5-1processed emblem. The special plate fees collected by the
2director under subsection 12, paragraph“a”, from the annual
3validation of letter-number designated combat infantryman
4badge, combat action badge, combat action ribbon, air force
5combat action medal, and combat medical badge plates, and
6subsection 12, paragraph “c”, from the issuance and annual
7validation of personalized combat infantryman badge, combat
8action badge, combat action ribbon, air force combat action
9medal, and combat medical badge plates shall be paid monthly
10to the treasurer of state and deposited in the road use tax
11fund. The treasurer of state shall transfer monthly from the
12statutory allocations fund created under section 321.145,
13subsection 2, to the veterans license fee trust fund created in
14section 35A.11 35A.13 the amount of the special fees collected
15under subsection 12, paragraph “a”, in the previous month for
16combat infantryman badge, combat action badge, combat action
17ribbon, air force combat action medal, and combat medical badge
18plates.
19   Sec. 9.  Section 321.34, subsection 24, paragraph a, Code
202020, is amended to read as follows:
   21a.  An owner referred to in subsection 12 who is the
22surviving spouse, parent, child, or sibling of a deceased
23member of the United States armed forces who died while serving
24on active duty during a time of military conflict or who died
25as a result of such service may order special registration
26plates bearing a gold star emblem upon written application
27to the department accompanied by satisfactory supporting
28documentation as determined by the department. The gold star
29emblem shall be designed by the department in cooperation with
30the commission of veterans affairs. The special plate fees
31collected by the director under subsection 12, paragraph“a”,
32from the annual validation of letter-number designated gold
33star plates, and subsection 12, paragraph “c”, from the issuance
34and annual validation of personalized gold star plates shall
35be paid monthly to the treasurer of state and deposited in
-6-1the road use tax fund. The treasurer of state shall transfer
2monthly from the statutory allocations fund created under
3section 321.145, subsection 2, to the veterans license fee

 trust fund created in section 35A.11 35A.13 the amount of the
5special fees collected under subsection 12, paragraph “a”, in
6the previous month for gold star plates.
7   Sec. 10.  Section 321.34, subsection 27, paragraph a, Code
82020, is amended to read as follows:
   9a.  An owner referred to in subsection 12 who served in the
10armed forces of the United States and was discharged under
11honorable conditions may, upon written application to the
12department and upon presentation of satisfactory proof of
13military service and discharge under honorable conditions,
14order special registration plates bearing a distinguishing
15processed emblem depicting the word “veteran” below an image
16of the American flag. The application is subject to approval
17by the department. The special plate fees collected by the
18director under subsection 12, paragraph “a”, from the annual
19validation of letter-number designated United States veteran
20plates, and subsection 12, paragraph “c”, from the issuance and
21annual validation of personalized United States veteran plates,
22shall be paid monthly to the treasurer of state and deposited
23in the road use tax fund. The treasurer of state shall
24transfer monthly from the statutory allocations fund created
25under section 321.145, subsection 2, to the veterans license
26fee
 trust fund created in section 35A.11 35A.13 the amount of
27the special fees collected under subsection 12, paragraph “a”,
28in the previous month for United States veteran plates.
29   Sec. 11.  REPEAL.  Section 35A.11, Code 2020, is repealed.
30   Sec. 12.  VETERANS LICENSE FEE FUND — DEPOSIT.  Moneys that
31remain unobligated or unexpended as of June 30, 2020, in the
32veterans license fee fund created in section 35A.11 shall be
33deposited in the veterans trust fund created in section 35A.13.
34EXPLANATION
35The inclusion of this explanation does not constitute agreement with
-7-1the explanation’s substance by the members of the general assembly.
   2This bill provides for the deposit of certain fees relating
3to special military-related motor vehicle registration plates
4to the veterans trust fund instead of the veterans license fee
5fund.
   6Code section 321.34, concerning special plates, is amended
7to provide that an amount equal to the special fees collected
8for the national guard special plates; Pearl Harbor special
9plates; purple heart special plates; United States armed
10forces retired special plates; silver or bronze star plates;
11distinguished service, navy, or air force cross plates;
12soldier’s, navy and marine corps, or airman’s medal plates; and
13combat infantryman badge, combat action badge, combat action
14ribbon, air force combat action medal, and combat medical badge
15plates shall be transferred to the veterans trust fund created
16in Code section 35A.13 instead of the veterans license fee fund
17created in Code section 35A.11.
   18The bill repeals the veterans license fee fund and provides
19that any moneys that remain unobligated or unexpended as of
20June 30, 2020, in the veterans license fee fund shall be
21deposited in the veterans trust fund.
