3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 135.185, subsection 1, paragraph b, Code
22020, is amended to read as follows:
   3b.  “Facility” means a food establishment as defined in
4section 137F.1, a carnival as defined in section 88A.1, a child
5care facility as defined in section 237A.1,
a recreational
6camp, a youth sports facility, or a sports arena.
7   Sec. 2.  DEPARTMENT OF HUMAN SERVICES — CHILD CARE
8FACILITIES — EPINEPHRINE AUTO-INJECTOR SUPPLIES.
  The
9department of human services shall adopt rules pursuant to
10chapter 17A to implement and administer this Act, including but
11not limited to standards and procedures for the prescription,
12distribution, storage, replacement, and administration of
13epinephrine auto-injectors, and for training and authorization
14to be required for personnel authorized to administer
15epinephrine.
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
   19This bill relates to child care facilities and epinephrine
20auto-injector supplies.
   21The bill amends the definition of “facility” for purposes
22of Code section 135.185, which allows a facility to obtain a
23prescription for epinephrine auto-injectors and maintain a
24supply of such auto-injectors in a secure location for use as
25provided in the Code section to include a child care facility
26as defined in Code section 237A.1. Personnel authorized to
27administer epinephrine may provide or administer an epinephrine
28auto-injector from the facility’s supply to an individual
29present at the facility if such personnel reasonably and in
30good faith believe the individual is having an anaphylactic
31reaction.
   32The bill requires the department of human services to adopt
33rules pursuant to Code chapter 17A to implement and administer
34the bill, including but not limited to standards and procedures
35for the prescription, distribution, storage, replacement, and

2and authorization to be required for personnel authorized to
3administer epinephrine.
