5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2rebuild iowa infrastructure fund
3   Section 1.  REBUILD IOWA INFRASTRUCTURE FUND —
4APPROPRIATIONS.
  There is appropriated from the rebuild Iowa
5infrastructure fund to the following departments and agencies
6for the following fiscal years, the following amounts, or so
7much thereof as is necessary, to be used for the purposes
8designated:
   91.  DEPARTMENT OF ADMINISTRATIVE SERVICES
   10FY 2020-2021:

   14a.  (1)  For deposit in the water quality initiative fund
15created in section 466B.45 for purposes of supporting the
16water quality initiative administered by the division of soil
17conservation and water quality as provided in section 466B.42,
18including salaries, support, maintenance, and miscellaneous
19purposes, notwithstanding section 8.57, subsection 5, paragraph
20“c”:

   23(2)  (a)  The moneys appropriated in this lettered
24paragraph shall be used to support demonstration projects in
25subwatersheds as designated by the department that are part
26of high-priority watersheds identified by the water resources
27coordinating council.
   28(b)  The moneys appropriated in this lettered paragraph
29shall be used to support demonstration projects in watersheds
30generally, including regional watersheds, as designated by the
31division and high-priority watersheds identified by the water
32resources coordinating council.
   33(3)  In supporting projects in watersheds and subwatersheds
34as provided in subparagraph (2), subparagraph divisions (a) and
35(b), all of the following shall apply:

   1(a)  The demonstration projects shall utilize water quality
2practices as described in the latest revision of the document
3entitled “Iowa Nutrient Reduction Strategy” initially presented
4in November 2012 by the department of agriculture and land
5stewardship, the department of natural resources, and Iowa
6state university of science and technology.
   7(b)  The division shall implement demonstration projects
8as provided in subparagraph division (a) by providing
9for participation by persons who hold a legal interest in
10agricultural land used in farming. To every extent practical,
11the division shall provide for collaborative participation by
12such persons who hold a legal interest in agricultural land
13located within the same subwatershed.
   14(c)  The division shall implement demonstration projects on
15a cost-share basis as determined by the division. Except for
16edge-of-field practices, the state’s share of the amount shall
17not exceed 50 percent of the estimated cost of establishing the
18practice as determined by the division or 50 percent of the
19actual cost of establishing the practice, whichever is less.
   20(d)  The demonstration projects shall be used to educate
21other persons about the feasibility and value of establishing
22similar water quality practices. The division shall promote
23field day events for purposes of allowing interested persons to
24establish water quality practices on their agricultural land.
   25(e)  The division shall conduct water quality evaluations
26within supported subwatersheds. Within a reasonable period
27after accumulating information from such evaluations, the
28division shall create an aggregated database of water quality
29practices. Any information identifying a person holding a
30legal interest in agricultural land or specific agricultural
31land shall be a confidential record.
   32(4)  The moneys appropriated in this lettered paragraph
33shall be used to support education and outreach in a manner
34that encourages persons who hold a legal interest in
35agricultural land used for farming to implement water quality
-2-1practices, including the establishment of such practices in
2watersheds generally, and not limited to subwatersheds or
3high-priority watersheds.
   4(5)  The moneys appropriated in this lettered paragraph
5may be used to contract with persons to coordinate the
6implementation of efforts provided in this paragraph.
   7(6)  The moneys appropriated in this lettered paragraph
8may be used by the department to support urban soil and water
9conservation efforts, which may include but are not limited
10to management practices related to bioretention, landscaping,
11the use of permeable or pervious pavement, and soil quality
12restoration. The moneys shall be allocated on a cost-share
13basis as provided in chapter 161A.
   14(7)  Notwithstanding any other provision of law to the
15contrary, the department may use moneys appropriated in
16this lettered paragraph to carry out the provisions of this
17paragraph on a cost-share basis in combination with other
18moneys available to the department from a state or federal
19source.
   20(8)  Not more than 10 percent of the moneys appropriated in
21this lettered paragraph may be used for costs of administration
22and implementation of the water quality initiative administered
23by the soil conservation division.
   24b.  For deposit in the renewable fuels infrastructure fund
25created in section 159A.16 for renewable fuel infrastructure

29ends three years after the end of the fiscal year for which the
30appropriation is made. However, if the project or projects for
31which such appropriation was made are completed in an earlier
32fiscal year, unencumbered or unobligated moneys shall revert at

32MISCELLANEOUS PROVISIONS
33   Sec. 5.  Section 8.57A, subsection 4, paragraph a, Code 2020,
34is amended by striking the paragraph.
35   Sec. 6.  Section 8.57A, subsection 4, Code 2020, is amended
-11-1by adding the following new paragraphs:
2   NEW PARAGRAPH.  d.  There is appropriated from the rebuild
3Iowa infrastructure fund every fiscal year commencing with the
4fiscal year beginning July 1, 2013, and ending with the fiscal
5year beginning July 1, 2019, the sum of forty-two million
6dollars to the environment first fund, notwithstanding section
78.57, subsection 5, paragraph “c”.
8   NEW PARAGRAPH.  e.  There is appropriated from the rebuild
9Iowa infrastructure fund for the fiscal year beginning July 1,
102020, and ending June 30, 2021, the sum of twenty-two million
11three hundred twenty thousand dollars to the environment first
12fund, notwithstanding section 8.57, subsection 5, paragraph
13“c”.
14   Sec. 7.  Section 8.57C, subsection 3, paragraph a,
15subparagraph (2), Code 2020, is amended to read as follows:
   16(2)  The fiscal year beginning July 1, 2020 2021, and for
17each subsequent fiscal year thereafter.
18   Sec. 8.  Section 8.57C, subsection 3, Code 2020, is amended
19by adding the following new paragraph:
20   NEW PARAGRAPH.  i.  There is appropriated from the rebuild
21Iowa infrastructure fund for the fiscal year beginning July 1,
222020, and ending June 30, 2021, the sum of thirty-five million
23dollars to the technology reinvestment fund, notwithstanding
24section 8.57, subsection 5, paragraph “c”.
25EXPLANATION
26The inclusion of this explanation does not constitute agreement with
27the explanation’s substance by the members of the general assembly.
   28This bill relates to and makes appropriations to state
29departments and agencies from the rebuild Iowa infrastructure
30fund and the technology reinvestment fund, and provides for
31related matters. The bill is organized by divisions.
   32DIVISION I — REBUILD IOWA INFRASTRUCTURE FUND. This
33division appropriates project funding for FY 2020-2021 from
34the rebuild Iowa infrastructure fund for projects for the
35departments of administrative services, agriculture and
-12-1land stewardship, cultural affairs, human services, natural
2resources, public defense, public safety, transportation, and
3veterans affairs, and for the law enforcement academy, board
4of regents, treasurer of state, and the judicial branch. The
5division also appropriates project funding from the rebuild
6Iowa infrastructure fund for FY 2020-2021 and FY 2021-2022 to
7the department of corrections and the economic development
8authority.
   9DIVISION II — TECHNOLOGY REINVESTMENT FUND. This
10division appropriates project funding for FY 2020-2021
11from the technology reinvestment fund for the departments
12of corrections, education, homeland security and emergency
13management, human rights, inspections and appeals, management,
14public health, public safety, revenue, and veterans affairs,
15and for the office of the chief information officer, law
16enforcement academy, and the judicial branch. This division
17also appropriates project funding for FY 2020-2021 and FY
182021-2022 from the technology reinvestment fund to the ethics
19and campaign disclosure board.
   20DIVISION III — MISCELLANEOUS PROVISIONS. Code section
218.57A, concerning the environment first fund, is amended to
22provide that the appropriation to the fund from the rebuild
23Iowa infrastructure fund for the fiscal year beginning July
241, 2020, is $22.32 million instead of $42 million. The bill
25further eliminates appropriations to the fund from the rebuild
26Iowa infrastructure fund for fiscal years beginning on or after
27July 1, 2021.
   28Code section 8.57C, concerning the technology reinvestment
29fund, is amended to provide that the standing appropriation to
30the fund from the general fund for fiscal years beginning on or
31after July 1, 2020, is changed to fiscal years beginning on or
32after July 1, 2021, and to provide for an appropriation to the
33fund from the rebuild Iowa infrastructure fund for the fiscal
34year beginning July 1, 2020, of $35 million.
