3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  BACKGROUND INFORMATION PROVIDED TO MENTAL HEALTH
2AND SUBSTANCE USE DISORDER TREATMENT PROVIDERS.
   31.  The department of corrections and the department of
4human services shall amend their administrative rules pursuant
5to chapter 17A to require the department of corrections, a
6judicial district department of correctional services, and the
7department of human services to provide specific background
8information to mental health and substance use disorder
9treatment providers at the time of referral of an individual
10for evaluation and treatment. The background information shall
11include all of the following:
   122.  The name of the individual referred for services,
13the individual’s last known address, and any other contact
14information.
   153.  The rationale for making the referral.
   164.  The reason for the department’s or agency’s involvement
17with the individual.
   185.  The individual’s current involvement with the department
19or agency.
   206.  Any corroborating information that supports the
21referral.
   227.  The information that the referring department or
23agency seeks to receive from the treatment provider providing
24the evaluation and treatment. The disclosure of any such
25information shall be consistent with the confidentiality
26protections under state and federal law.
27EXPLANATION
28The inclusion of this explanation does not constitute agreement with
29the explanation’s substance by the members of the general assembly.
   30This bill relates to background information provided to
31mental health and substance use disorder treatment providers.
   32The bill requires the department of corrections, a judicial
33district department of correctional services, and the
34department of human services to provide specific background
35information concerning an individual who is referred to a
-1-1treatment provider for mental health or substance use disorder
2evaluation and treatment. The referring department or agency
3is directed to provide information to the treatment provider
4who is requested to evaluate and provide treatment to the
5individual including the name of the individual referred for
6services, the individual’s last known address, and any other
7contact information; the rationale for making the referral;
8the reason for the department’s or agency’s involvement
9with the individual; the individual’s current involvement
10with the department or agency; any corroborating information
11that supports the referral; and the information that the
12referring department or agency seeks to receive from the
13treatment provider providing the evaluation and treatment. The
14disclosure of any such information shall be consistent with the
15confidentiality protections under state and federal law.
